Concerning the licence fee, the Commission takes note of the Court’s findings in its judgment (32). In particular, the amount is determined by the Danish authorities; the obligation to pay the licence fee does not arise from a contractual relationship between TV2 and the person liable to pay but simply from the fact of owning a television or radio receiver; where necessary, the licence fee is collected in accordance with the rules on the collection of personal taxes; and, lastly, it is the Danish authorities that determine TV2’s share of the income from licence fees.
Wat de omroepbijdrage betreft, verwijst de Commissie naar de overwegingen in het arrest van het Gerecht (32), met name de overwegingen dat het bedrag van de bijdrage wordt vastgesteld door de Deense autoriteiten, dat de verplichting tot betaling van de bijdrage niet voortvloeit uit een contractuele band tussen TV2 en de betalingsplichtige, maar louter uit het bezit van een televisie- of radiotoestel, dat die bijdrage in voorkomend geval wordt geïnd volgens de regels betreffende de inning van belastingen en dat ten slotte de Deense autoriteiten bepalen welk deel van de omroepbijdrage aan TV2 toekomt.
