1. In so far as is necessary in order to achieve the objectives set out in this Regulation, and without prejudice to the respective competences of the Member States, the institutions of the Union and the European External Action Service, the Agency may strengthen coordination with international organisations on the basis of concluded agreements and develop contacts and enter into administrative arrangements with supervisory authorities, international organisations and the administrations of third countries competent in matters covered by Agency activities in order to keep up with scientific and technical developments and to ensure promotion of the Union railways legislation and standards.

Since the objectives of this Directive, namely to foster the development of the Union railways, to set out broad principles for granting licences to railway undertakings and to coordinate arrangements in the Member States governing the allocation of railway infrastructure capacity and the charges made for the use thereof, cannot be sufficiently achieved by the Member States on account of the manifestly international dimension of issuing such licences and operating significant elements of the railway networks, and of the need to ensure fair and non-discriminatory terms for access to the infrastructure, and can therefore, by reason of their trans-national implications, be better achieved at Union level, the Union may adopt measures in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty on European Union.

Railway tunnel experts from the International Union of Railways (UIC) and the United Nations Economic Commission for Europe (UNECE) have evaluated and assembled, in the 2000-2003 period, the best measures currently applied in Europe to ensure safety in new and existing tunnels.

The Commission also discussed the basic principles of this proposal with safety experts, including representatives of safety authorities, ministries, infrastructure managers and railway undertakings, the International Union of Railways (IUR) and the International Liaison Group of Government Railway Inspectorates (ILGGRI).

The most important railway noise source identified in the document is rail freight, and it proposes two key measures: noise emission limits for interoperable vehicles, and retrofitting of existing cast-iron block braked freight wagons with composite brake blocks - which can reduce noise emissions by 8 dB(A) to 10 dB(A) (in October 2003, the UIC (International Union of Railways) gave approval to the use in international traffic of wagons equipped with 'K' type composite brake blocks).

In particular, the Commission investigates with UIC, CER (Community of European Railways), UNIFE (European rail supply industry), UIRR (International Union of combined Road-Rail transport companies) and UIP (International Union of Private Wagons) the status and options for the reduction of noise emission from the existing European rail freight wagon fleet, including a third-party assessment of the UIC/UIP/CER Action Programme for Noise Reduction in Freight Traffic.
