The CN, established by Regulation (EEC) No 2658/87, is based on the international Harmonized Commodity Description and Coding System (HS) drawn up by the Customs Cooperation Council, now the World Customs Organization (WCO), adopted by the International Convention, concluded in Brussels on 14 June 1983 and approved on behalf of the European Economic Community by Council Decision 87/369/EEC (‘the HS Convention’).

Consequently, the corresponding HS codes specified in the list of goods involving higher risk of fraud of Annex I to Appendix I to the Convention of 20 May 1987 on a common transit procedure (the ‘Convention’) should be amended accordingly.

Whereas the Customs Cooperation Council approved the International Convention on the Harmonized Commodity Description and Coding System (hereinafter referred to as the 'HS'); whereas that Convention was approved by the Council by Decision 87/369/EEC (5) and has been applied since 1 January 1988; whereas a combined nomenclature has accordingly been established to give effect to the HS within the European Economic Community; whereas the reference in Article 5 (6) of Directive 69/169/EEC should therefore be to the said combined nomenclature;
Overwegende dat de Internationale Douaneraad het »Internationale Verdrag betreffende het geharmoniseerd systeem inzake de omschrijving en de codering van goederen", hierna »GS" genoemd, heeft goedgekeurd; dat de Raad dit Verdrag bij Besluit 87/369/EEG (5) heeft goedgekeurd en dat het sedert 1 januari 1988 wordt toegepast; dat bijgevolg met het oog op de toepassing van het GS in de Europese Economische Gemeenschap een gecombineerde nomenclatuur werd uitgewerkt; dat de verwijzing in artikel 5, lid 6, van Richtlijn 69/169/EEG dan ook op deze gecombineerde nomenclatuur dient te zijn gebaseerd;
