The authorities of one of the Member States pointed out the fact that, according to the explanatory notes to the Combined Nomenclature (4), the expression ‘malleable’ includes spheroidal graphite cast iron (identical to ductile cast iron).
De autoriteiten van een van de lidstaten hebben gewezen op het feit dat overeenkomstig de toelichtingen op de gecombineerde nomenclatuur (4) het begrip "smeedbaar gietijzer" ook nodulair gietijzer omvat.

In order to clarify whether the findings with regard to castings made of grey and ductile cast iron as set out in the definitive measures Regulation were indeed correct, it was examined whether ductile iron castings and grey iron castings were rightly considered to share the same physical, chemical and technical characteristics and end uses, as indicated in the definitive measures Regulation.
Om na te gaan of de bevindingen in de definitieve verordening ten aanzien van gietstukken van grijs en nodulair gietijzer inderdaad correct waren, werd onderzocht of deze soorten gietstukken terecht geacht werden dezelfde fysieke kenmerken en chemische en technische eigenschappen te hebben en voor dezelfde doelen te worden gebruikt, zoals in de definitieve verordening werd gesteld.

In particular, it should be clarified that the product scope covers castings of non-malleable cast iron and of spheroidal graphite cast iron (ductile iron).
In het bijzonder moet worden verduidelijkt dat de productomschrijving betrekking heeft op gietstukken van niet-smeedbaar gietijzer en op die van nodulair gietijzer.

In view of the above findings, it is considered appropriate to revise Regulation (EC) No 1212/2005 in order to clarify the scope of the product covered by that Regulation and to insert that the product scope covers castings of non-malleable cast iron and of spheroidal graphite cast iron (ductile iron).
Gezien bovenstaande bevindingen wordt het dienstig geacht Verordening (EG) nr. 1212/2005 te wijzigen door hierin op te nemen dat de productomschrijving betrekking heeft op gietstukken van niet-smeedbaar en van nodulair gietijzer.
