Believes that better financial regulation implies a robust framework and starts with Member States applying the current acquis ; stresses that effective, efficient and consistent implementation of the legislation is crucial and calls on the Commission for regular reports to Parliament on the state of transposition and implementation of the legislation, and where applicable, the infringement proceedings brought against Member States; urges the Member States to properly enforce the legislation; considers that gold-plating does not facilitate the functioning of the internal market and competition; considers that attracting business through the discretionary use of lower standards does not facilitate the functioning of the internal market either; asks the Commission to come up with a thorough analysis and report of all gold-plating measures taken by Member States in the field of financial legislation and to submit them to Parliament by the end of 2016;
42. gelooft dat betere financiële regelgeving een robuust kader vergt en begint bij de toepassing door de lidstaten van het huidige acquis ; benadrukt dat een doeltreffende, efficiënte en consequente toepassing van de wetgeving van essentieel belang is en verzoekt de Commissie op gezette tijden verslag uit te brengen aan het Parlement over de stand van de omzetting en tenuitvoerlegging van de wetgeving alsook, waar nodig, over de inbreukprocedures die zij tegen lidstaten heeft ingeleid; dringt er bij de lidstaten op aan de wetgeving naar behoren te handhaven; is van mening dat overregulering de werking van de interne markt en de concurrentie niet ten goede komt; is van mening dat het aantrekken van ondernemingen door het willekeurig gebruik van lagere normen de werking van de interne markt eveneens niet ten goede komt; verzoekt de Commissie om met een grondige analyse en een verslag te komen over alle te sterk regulerende wetgevingsmaatregelen van de lidstaten op het gebied van financiële diensten, en deze uiterlijk eind 2016 aan het Parlement te doen toekomen;

Stresses, further, the need to obtain a fuller overview of risk transfers by financial institutions, including but not limited to transfers effected through derivative transactions, data for which will be provided under EMIR and MIFID/MIFIR, in order to determine who has purchased what from whom and how the transferred risks are supported; emphasises that it should be an objective to achieve real-time transaction mapping in all financial services and that this is aided by and can be automated via standardised messaging and data identifiers; invites the Commission, therefore, in consultation with the ESRB and international bodies such as the FSB, to include in its report on central data collection the current work on standardised messaging and data formats and the feasibility of setting up a central registry for risk transfers, which should be able to capture and monitor risk transfer data in real time, making full use of data provided under the reporting requirements of existing and future financial legislation and incorporating internationally available data;
12. benadrukt eveneens de behoefte aan een vollediger zicht op risico-overdrachten door financiële instellingen, met inbegrip van – doch niet beperkt tot – door middel van derivatentransacties doorgevoerde overdrachten, waarvoor gegevens dienen te worden verstrekt uit hoofde van de EMIR-verordening en de MiFID/MiFIR-richtlijnen, om te kunnen bepalen wie wat van wie heeft gekocht en hoe de overgedragen risico's worden gedragen; wijst er met nadruk op dat moet worden gestreefd naar realtimekartering van transacties voor alle financiële diensten en dat deze vorm van kartering kan worden ondersteund en geautomatiseerd door middel van gestandaardiseerde berichten- en gegevensidentificatoren; verzoekt de Commissie hiertoe om – in overleg met het ESRB en internationale organen zoals de FSB – in haar een verslag over centrale gegevensvergaring de lopende werkzaamheden op het gebied van gestandaardiseerde berichten- en gegevensformaten op te nemen en de haalbaarheid van de oprichting van een centraal register voor risico-overdrachten, dat data betreffende risico-overdrachten in realtime kan inwinnen en monitoren, met volledige gebruikmaking van de informatie die wordt verstrekt in het kader van de rapportageverplichtingen welke voortvloeien uit bestaande en toekomstige financiële wetgeving, inclusief internationaal beschikbare gegevens;
