11. Where a farmer is granted financial compensation by a mutual fund under this Article any legal right for the recovery of damages for the compensated economic losses which the farmer may have under any provisions of Community or national law against any third party shall be transferred to the mutual fund in accordance with rules to be established by the Member State concerned.

4. Member States shall ensure that economic losses for which financial compensation is granted in accordance with other Community provisions, including Article 44 of Regulation (EC) No 1234/2007 and any other health and veterinary or plant health measures, shall not be further compensated in accordance with paragraph 1.

5. The overall financial contribution comprises a financial compensation, amounts earmarked for financing sustainable management measures, and allocations for the purchase by Guinea of surveillance vessels. The financial compensation may increase in line with the fishing opportunities in Table 1.

The protocol provides that the "Senegalese authorities shall be responsible for determining the use made of this compensation and shall notify the Commission "of the details of that use, using as a basis the aims of sustainable development of fishing, including non-industrial fishing, listed in the previous Protocol (financial compensation to the Treasury, knowledge of fish stocks, training, fisheries surveillance, institutional assistance, special programme of action for fishing activities, etc.)" .
