Although many Member States apply European Radiocommunications Committee (ERC) Recommendation 70-03, and Annex 10 thereto , and ERC Recommendation 25-10, and Annex 2 thereto which provide guidance on the frequency bands and technical parameters for PMSE equipment, these recommendations do not legally guarantee the harmonisation of spectrum used by PMSE equipment across the Union.

(14) Whereas spectrum allocation is most efficiently pursued in the context of the CEPT by the European Radiocommunications Committee (ERC); whereas it should be ensured that appropriate and timely regulatory measures are taken to achieve the implementation in the Community of ERC decisions if necessary; whereas Member States should be encouraged to provide the Commission with regular information as to the implementation of ERC measures; whereas complementary Community action may be required to ensure the timely implementation of CEPT decisions within Member States;
(14) Overwegende dat het Europees Comité voor radio-communicatie (ERC) in de context van de CEPT voor de meest efficiënte spectrumtoewijzing zorgt; dat ervoor moet worden gezorgd dat op tijd de geëigende regelgevende maatregelen worden genomen om zo nodig voor de uitvoering van de ERC-besluiten in de Gemeenschap te zorgen; dat de lidstaten moeten worden aangemoedigd de Commissie geregeld informatie te verstrekken over de uitvoering van ERC-maatregelen; dat aanvullende communautaire maatregelen nodig kunnen zijn om te zorgen voor een tijdige uitvoering van de CEPT-besluiten in de lidstaten;
