Annex I to the Act of Accession lists the seven relevant conventions and protocols in the justice and home affairs sphere, including: the Convention of 26 July 1995, drawn up on the basis of Article K.3 of the Treaty on European Union, on the use of information technology for customs purposes; the Protocol of 29 November 1996, drawn up on the basis of Article K.3 of the Treaty on European Union, on the interpretation, by way of preliminary rulings, by the Court of Justice of the European Communities of the Convention on the use of information technology for customs purposes; the Protocol of 12 March 1999, drawn up on the basis of Article K.3 of the Treaty on European Union, on the scope of the laundering of proceeds in the Convention on the use of information technology for customs purposes and the inclusion of the registration number of the means of transport in the Convention; and the Protocol of 8 May 2003, established in accordance with Article 34 of the Treaty on European Union, amending, as regards the creation of a customs files identification database, the Convention on the use of information technology for customs purposes.

It should be highlighted as well that border management is not focussing solely on the immigration aspect but also on other purposes: customs purposes, traffic security, prevention of the entry of dangerous or illegal goods, identification of persons wanted for arrest or extradition at a request of a competent judicial authority etc.

FOR THE PURPOSES OF APPLYING THE PROVISIONS OF COUNCIL REGULATION ( EEC ) NO 803/68 OF 27 JUNE 1968 ON THE VALUATION OF GOODS FOR CUSTOMS PURPOSES , AND WITHOUT PREJUDICE TO THE OTHER CONDITIONS SET OUT IN THAT REGULATION , THE PRICE PAID OR PAYABLE SHALL BE ACCEPTED AS THE VALUE FOR CUSTOMS PURPOSES ONLY IF IT HAS BEEN MADE ON A SALE TO A BUYER ESTABLISHED IN THE CUSTOMS TERRITORY OF THE COMMUNITY .
Voor de toepassing van Verordening ( EEG ) nr . 803/68 van de Raad van 27 juni 1968 inzake de douanewaarde van de goederen en onverminderd de andere in die verordening vermelde voorwaarden kan de betaalde of te betalen prijs slechts als douanewaarde worden aanvaard indien die prijs is overeengekomen bij een verkoop aan een in het douanegebied van de Gemeenschap gevestigde koper .

WHEREAS ARTICLE 1 ( 1 ) OF THAT REGULATION LAYS DOWN THAT FOR THE PURPOSE OF APPLYING THE COMMON CUSTOMS TARIFF THE VALUE FOR CUSTOMS PURPOSES OF THE GOODS IMPORTED SHALL BE TAKEN TO BE THE PRICE WHICH THEY WOULD FETCH ; WHEREAS , PURSUANT TO PARAGRAPH 2 OF THAT ARTICLE , IT IS ASSUMED THAT " THE GOODS ARE DELIVERED TO THE BUYER AT THE PLACE OF INTRODUCTION INTO THE CUSTOMS TERRITORY OF THE COMMUNITY " AND THAT " THE SELLER BEARS ALL COSTS , CHARGES AND EXPENSES INCIDENTAL .TO THE DELIVERY OF THE GOODS AT THE PLACE OF INTRODUCTION " ;
Overwegende dat artikel 1 , lid 1 , van bovengenoemde verordening bepaalt dat voor de toepassing van het gemeenschappelijk douanetarief de douanewaarde van in te voeren goederen de prijs is welke geacht wordt voor die goederen te kunnen worden bedongen ; dat krachtens lid 2 van hetzelfde artikel ervan wordt uitgegaan dat " de goederen aan de koper worden geleverd op de plaats van binnenkomst in het douanegebied van de Gemeenschap " en dat " de verkoper alle kosten draagt die betrekking hebben op de .levering van de goederen op de plaats van binnenkomst " ;

WHEREAS THE ESTABLISHMENT OF THE CUSTOMS UNION IS GOVERNED IN THE MAIN BY TITLE 1 , CHAPTER 1 OF THE TREATY ; WHEREAS THAT CHAPTER OF THE TREATY CONTAINS A SERIES OF SPECIFIC PROVISIONS , DEALING IN PARTICULAR WITH THE ELIMINATION OF CUSTOMS DUTIES BETWEEN MEMBER STATES , THE ESTABLISHMENT AND PROGRESSIVE INTRODUCTION OF THE COMMON CUSTOMS TARIFF AND THE AUTONOMOUS ALTERATION OR SUSPENSION OF THE DUTIES THEREIN ; WHEREAS THE WORDS " AUTONOMOUS ALTERATION OR SUSPENSION OF DUTIES IN THE COMMON CUSTOMS TARIFF " IN ARTICLE 28 , DO NOT MAKE IT POSSIBLE TO BASE THE PROVISIONS RELATING TO VALUE FOR CUSTOMS PURPOSES ON THAT ARTICLE ; WHEREAS , WHILE ARTICLE 27 PROVIDES THAT MEMBER STATES SHALL , BEFORE THE END OF THE FIRST STAGE AND IN SO FAR AS MAY BE NECESSARY , TAKE STEPS TO APPROXIMATE THEIR PROVISIONS LAID DOWN BY LAW , REGULATION OR ADMINISTRATIVE ACTION IN RESPECT OF CUSTOMS MATTERS , THAT ARTICLE DOES NOT EMPOWER THE INSTITUTIONS OF THE COMMUNITY TO ISSUE BINDING PROVISIONS IN THAT FIELD ; WHEREAS , HOWEVER , A THOROUGH EXAMINATION , UNDERTAKEN JOINTLY WITH MEMBER STATES , HAS SHOWN THE NEED IN CERTAIN FIELDS FOR DECISION , BY BINDING ACTS OF THE COMMUNITY , UPON MEASURES ESSENTIAL FOR THE INTRODUCTION OF CUSTOMS LEGISLATION WHICH WILL ENSURE UNIFORM APPLICATION OF THE COMMON CUSTOMS TARIFF ;
Overwegende dat de invoering van de douane-unie hoofdzakelijk is geregeld in titel I , hoofdstuk 1 ; dat dat hoofdstuk van het Verdrag een samenstel van nauwkeurige voorschriften omvat , in het bijzonder betreffende de afschaffing van de douanerechten tussen de Lid-Staten , de vaststelling en de geleidelijke invoering van het gemeenschappelijk douanetarief en de autonome wijzigingen of schorsingen van de rechten van dat tarief ; dat de woorden " autonome wijzigingen of schorsingen van de rechten van het gemeenschappelijk douanetarief " in artikel 28 niet toelaten bedoeld artikel als grondslag te nemen voor de bepalingen betreffende de douanewaarde ; dat , ook al wordt in artikel 27 bepaald dat de Lid-Staten v}}r het einde van de eerste etappe , voor zover noodzakelijk , overgaan tot het nader tot elkaar brengen van hun wettelijke en bestuursrechtelijke bepalingen op douanegebied , dit artikel aan de Instellingen van de Gemeenschap niet de bevoegdheid toekent , dwingende bepalingen ter zake vast te stellen ; dat bij een diepgaand onderzoek , waartoe met de Lid-Staten werd overgegaan , nochtans de noodzakelijkheid is gebleken , in bepaalde sectoren middels dwingende communautaire besluiten de maatregelen vast te stellen welke onontbeerlijk zijn voor de invoering van een douanewetgeving welke een uniforme toepassing van het gemeenschappelijk douanetarief verzekert ;
