The present EU legal provisions on payments are contained in different types of EU legal instruments: a Regulation (2560/2001/EC) introducing the equality of charges for cross-border intra-EU payments in euro and corresponding national payments, which is directly legally binding without transposition into national law; a Directive (97/5/EC) [11] facilitating cross-border credit transfers in establishing some customers' protection requirements, which had to be transposed into national law to become applicable; a Recommendation (97/489/EC) [12] providing for the protection of customers using electronic payment instruments, such as payment cards, which - although not a legally binding instrument - was supposed to be fully implemented and applied in the EU. The co-existence of the three key legal acts is confusing [13] since several provisions overlap.

Presently, no comprehensive legislation exists at EU-level on the issue of unauthorised transactions: Recommendation 97/489/EC regulates the relationship between the issuer and the holder of electronic payment instruments in this respect. Directive 97/7/EC and Directive 2002/65/EC regulate the case of fraudulent use of a card payment in distance commerce.
Momenteel is er op EU-niveau geen allesomvattende wetgeving inzake transacties waarvoor geen toestemming is gegeven: Aanbeveling 97/489/EG regelt in dit verband de betrekking tussen de uitgever en de houder van elektronische betaalinstrumenten, terwijl Richtlijn 97/7/EG en Richtlijn 2002/65/EG betrekking hebben op het frauduleus gebruik van kaartbetalingen bij handel op afstand.
