A General Assistance Document, through which the Commission informed the Phare Management Committee of the co-ordination of pre-accession aid in 2004, was presented to Member States at the Phare Management Committee on 10 June 2004. In particular, this document provided the indicative financial allocations for the year for each country in relation to the three instruments, information on co-ordination with EIB and IFIs and about progress and perspectives for decentralised management.

As a formal decision of the EIB which is duly published and implemented, a provision governing the scope of the review to be carried out by the EIB’s appeals committee establishes an internal rule of general scope which is legally binding and limits the EIB’s discretion in relation to the organisation of its structures and the management of its staff. Members of staff are entitled to rely on the rule before the Courts of the Union, which will ensure that it is observed.

13. Is satisfied with the approval by the EIB Management Committee of the EIB Complaints Mechanism Policy; reiterates its call on the EIB to review its internal grievance mechanism and to issue new appeal mechanism guidelines extended to all EIB-financed operations, however;
13. is verheugd dat het directiecomité van de EIB het EIB-beleid inzake de klachtenregeling heeft goedgekeurd; herhaalt echter haar verzoek aan de EIB om haar interne geschillenregeling te herzien en nieuwe richtsnoeren op te stellen voor beroepsprocedures die alle door de EIB gefinancierde operaties zouden moeten omvatten;

As in the case of the other general terms of employment adopted by the EIB in the exercise of its regulatory powers, the applicability of the code of conduct approved by the Management Committee of the EIB, laying down rules in the area of professional ethics, does not depend on the prior consent of the member of staff concerned.
3. In navolging van de andere algemene arbeidsvoorwaarden die de EIB krachtens haar regelgevende bevoegdheden heeft vastgesteld, hangt de toepasselijkheid van de door de directie van de EIB goedgekeurde gedragscode, waarin de regels inzake de beroepsethiek worden gepreciseerd, niet af van de voorafgaande instemming van het betrokken personeelslid.

8. It is not for the Community Court to make findings of principle or to issue directions to the administration so that a request by a member of staff of the EIB for a declaration that the code of conduct approved by the Management Committee of the EIB does not apply to him must be declared inadmissible.
8. Het staat niet aan de gemeenschapsrechter om principiële vaststellingen te doen of om de administratie een bevel te geven, zodat het verzoek van een personeelslid van de EIB om de door de directie van de EIB goedgekeurde gedragscode niet op hem van toepassing te verklaren, niet-ontvankelijk moet worden verklaard.
