J. whereas on 21 September 2011 Turkey signed an agreement with Turkish-Cypriot leaders on the delimitation of the continental shelf in the eastern Mediterranean; whereas the continental shelf is an area of maritime jurisdiction in which coastal states exercise sovereign rights for the purpose of exploring and exploiting their natural resources in the seabed and subsoil;
J. overwegende dat Turkije op 21 september 2011 met de Turks-Cypriotische leiders een overeenkomst heeft getekend over de afbakening van het continentaal plat in de oostelijke Middellandse Zee; overwegende dat het continentaal plat een gebied onder maritieme jurisdictie is, waarin kuststaten soevereine rechten uitoefenen om hun natuurlijke grondstoffen onder de zeebodem en onder de grond te exploreren en te exploiteren;

– having regard to the Protocol for the Protection of the Mediterranean Sea against pollution resulting from exploration and exploitation of the continental shelf and the seabed and its subsoil, attached to the above-mentioned draft Council decision,

Since a Member State has sovereignty over the continental shelf adjacent to it – albeit functional and limited sovereignty – work carried out on fixed or floating installations positioned on the continental shelf, in the context of the prospecting and/or exploitation of natural resources, is to be regarded as work carried out in the territory of that State for the purposes of applying EU law.
Aangezien het tot een lidstaat behorende gedeelte van het continentaal plat onder de, zij het functionele en beperkte, soevereiniteit van die staat valt, moet arbeid die een werknemer op vaste of drijvende installaties die zich op het continentaal plat bevinden, in het kader van de exploratie en/of exploitatie van natuurlijke rijkdommen verricht, voor de toepassing van het Unierecht worden aangemerkt als arbeid verricht op het grondgebied van die staat.

Accordingly, the Rechtbank Amsterdam (Amsterdam District Court) asked the Court of Justice whether EU law precludes an employee, working on a fixed installation on the continental shelf adjacent to a Member State, from being in a position in which he is not compulsorily insured under national legislation in that Member State solely on the ground that he is not resident there but in another Member State.

The coastal State has the exclusive right to construct the artificial islands, installations and structures on the continental shelf, to authorise them and to regulate their construction, operation and use.

20. Is conscious of the different interpretations of the Svalbard/Spitsbergen Treaty with regard to its applicability to the continental shelf and the maritime zones of Svalbard/Spitsbergen, and, given the relatively good accessibility of resources in the continental shelf, would welcome an agreement on the legal status of the shelf acknowledging the legal rights and duties of the costal shelf states; is confident that any disputes which may arise will be dealt with in a constructive way;
20. is zich bewust van de uiteenlopende interpretaties van het Verdrag van Svalbard/Spitsbergen met betrekking tot zijn toepasselijkheid op het continentaal plat en de maritieme zones van Svalbard/Spitsbergen, gezien de betrekkelijk goede toegankelijkheid van hulpbronnen op het continentaal plat; zou een overeenkomst over de juridische status van het plat en erkenning van de wettelijke rechten en plichten van de kustlanden ten aanzien van het plat toejuichen; vertrouwt erop dat eventuele geschillen op een constructieve manier worden afgelost;
