The rapporteur takes the view that the Committee on Legal Affairs should recommend to the committee responsible that it give its approval of the Council Decision on the conclusion of the agreement between the European Union and the Russian Federation on drug precursors.

Since only small quantities of drug precursors are required for the production of illegal drugs, and since such precursors are produced globally in vast quantities, great care is needed to ensure that those drug precursors are not diverted from the legal trade in the EU.

(12) This Regulation should not apply to drug precursors because the diversion of those chemical substances for the purpose of manufacturing narcotic drugs or psychotropic substances is addressed under Regulation (EC) No 273/2004 of the European Parliament and of the Council of 11 February 2004 on drug precursors[16] and Council Regulation (EC) No 111/2005 of 22 December 2004 laying down rules for the monitoring of trade between the Community and third countries in drug precursors[17].

Even though there is a lack of available quantitative evidence that control of legal trade is indeed reducing globally diversion and trafficking of drug precursors, it is clear that the control system in place raises important barriers to access to drug precursors by traffickers and reduce overall availability of drug precursors for illicit drug manufacture.
Hoewel de beschikbare kwantitatieve gegevens ontoereikend zijn om te kunnen concluderen dat de controle van de legale handel wereldwijd het misbruik en de illegale verhandeling van drugsprecursoren daadwerkelijk doet afnemen, is wel duidelijk dat het bestaande controlesysteem illegale handelaren sterk hindert bij de toegang tot drugsprecursoren en de algehele beschikbaarheid van drugsprecursoren voor de illegale vervaardiging van drugs beperkt.

1. The Commission shall be assisted by the Drug Precursors Committee (hereinafter referred to as the Committee).

In addition to the implementing measures referred to in this Regulation, the Committee shall lay down, where necessary, detailed rules to ensure the effective monitoring of trade between the Community and third countries in drug precursors for the purpose of preventing the diversion of such substances, in particular with regard to the design and use of export and import authorisation forms.
Afgezien van de in deze verordening bedoelde uitvoeringsmaatregelen stelt het comité indien nodig nadere bepalingen vast om het effectieve toezicht op de handel tussen de Gemeenschap en derde landen in drugsprecursoren te waarborgen teneinde misbruik van dergelijke stoffen te voorkomen, met name wat betreft het ontwerp en het gebruik van de formulieren voor de uitvoer- en invoervergunningen.

(16 ) Since the objectives of the proposed action, the harmonised monitoring of the trade in drug precursors and the avoidance of its diversion to the illicit manufacture of narcotic drugs or psychotropic substances , cannot be sufficiently achieved by the Member States, and can therefore, by reason of its international and changeable nature, be better achieved at Community level, the Community may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty.
(16) Daar de doeleinden van het voorgestelde optreden, namelijk een geharmoniseerd toezicht op de handel in drugsprecursoren en het voorkomen van misbruik van deze precursoren voor de illegale vervaardiging van verdovende middelen of psychotrope stoffen , niet voldoende door de lidstaten kunnen worden verwezenlijkt en wegens hun internationale en veranderlijke aard beter door de Gemeenschap kunnen worden verwezenlijkt, kan de Gemeenschap overeenkomstig het subsidiariteitsbeginsel van artikel 5 van het Verdrag maatregelen treffen.
