- The informal EU Network for the Implementation and Enforcement of Environmental Law (IMPEL), a regular gathering between the Commission, Member States and acceding countries, [57] provides an opportunity for exchanging information and best practice and for injecting greater consistency to implementation, application and enforcement of environmental legislation. A major boost to IMPEL was the introduction, in 2001, of a scheme under which Member States report and offer advice on inspectorates and inspection procedures on implementation. [58] This mechanism has contributed to drawing up minimum qualifications criteria and training programmes for inspectors; as well as to strengthening cross-border co-operation of inspections and in turn preventing illegal cross-border environmental practices.

Today the European Commission adopted a guidance document on access to justice in environmental matters which clarifies how individuals and associations can challenge decisions, acts and omissions by public authorities related to EU environmental law before national courts.

42. Calls on the Commission and the Member States to explicitly define a specific timeframe in which court cases relating to the implementation of environmental law shall be resolved, in order to prevent the implementation of the environmental law and delays in court cases from being used as an excuse to avoid compliance and hinder investments; calls on the Commission to assess how many investments have been held back because of delays in legal proceedings relating to irregularities on the implementation of environmental legislation;

35. Calls on the Commission to increase its capacity to process and investigate effectively complaints and infringements connected with the proper implementation of the Birds and Habitats Directives, and to develop adequate guidance for the Member States with regard to monitoring on-the-ground implementation of those directives; calls on the Commission, furthermore, to incorporate measures to enhance the implementation and joint enforcement of the Birds and Habitats Directives into its current work on improving the implementation and inspection of environmental legislation; considers it essential, in the light of its resolution of 20 November 2008 on the review of Recommendation 2001/331/EC providing for minimum criteria for environmental inspections in the Member States , to strengthen the EU Network for the Implementation and Enforcement of Environmental Law (IMPEL), and urges the Commission to report on possible ways of doing so, including the feasibility of establishing an EU environmental inspection force, and to present a proposal for a directive on environmental inspections;

28. Requests, as regards the implementation of the cohesion policy, that the Commission ensure that both the partnership principle according to Article 11 of Council Regulation (EC) No 1083/2006 laying down genePersonNameral provisions on the structural funds is fully applied and gender mainstreaming as well as environmental protection are entirely respected in the implementation of opePersonNameraPersonNametional programmes; calls on the Commission to prevent any use of structuPersonNameral funds that violates Community law, especially environmental law and believes that the Commission should consistently suspend funding when there are serious doubts as to the respect for EU law;
28. verzoekt de Commissie ten aanzien van de uitvoering van het cohesiebeleid erop toe te zien dat het partnerschapsbeginsel overeenkomstig artikel 11 van Verordening (EG) nr. 1083/2006 van de Raad tot vaststelling van algemene voorschriften inzake de structuurfondsen ten volle wordt toegepast en dat gendermainstreaming en milieubescherming volledig in acht worden genomen bij de uitvoering van operationele programma's; wenst dat de Commissie elk gebruik van de structuurfondsen dat in strijd is met het Gemeenschapsrecht, met name het milieurecht, verhindert, en is van mening dat de Commissie subsidies consequent moet opschorten als er ernstige twijfels bestaan omtrent de naleving van het EU-recht;

Welcomes the Commission's resolve, stated in the aforementioned working paper SEC (2003) 804, to ensure, especially in field of environmental law, that Community rules are 'enforcement-friendly', that guidelines and interpretative texts are prepared in consultation with all stakeholders, that there is proactive contact with Member States (including, it is hoped, their relevant regional authorities), and that use is made of the informal EU network on implementing environmental law;

We should make it quite clear to countries which contravene environmental legislation that the Commission, which is the guardian of primary and secondary Community law, will ensure that the environment is not damaged when projects are constructed. This flagrant violation of our basic environmental laws must not be allowed to continue.
De landen die de milieuwetgeving overtreden, moeten derhalve de boodschap van de Commissie goed in hun oren knopen. De Commissie moet er als hoedster van het primair en secundair communautair recht immers op toezien dat het milieu niet wordt vernietigd met de bouw van allerlei werken.
