- A civil bankruptcy procedure (known in France as "rétablissement personnel"), whereby persons of good faith who are permanently unable to repay their debts due to insufficient means can have their debts written off, has been introduced in Germany, is the subject of a new law in France, is being debated in Belgium and is slated to form part of a reform package in Finland which will also cover debt restructuring and seizure procedures.
- Een faillissementsprocedure (in Frankrijk "rétablissement personnel" geheten), die een kwijtschelding van schulden mogelijk maakt voor personen te goeder trouw die vanwege te weinig middelen permanent niet in staat zijn tot aflossing is in Duitsland ingevoerd en in Frankrijk in een nieuwe wet geregeld; in België wordt deze benadering overwogen in Finland wordt een hervorming voorbereid die tevens betrekking zal hebben op schuldensanering en beslagprocedures.

In addition, certain areas of civil law are excluded from the scope of the regulation, including rights in property arising out of a matrimonial relationship, wills and succession, bankruptcy, social security and arbitration (see Article 2(2)).
