(5) Whereas the third sentence of Article 109l (4) of the Treaty, which allows the Council, acting with the unanimity of participating Member States, to take other measures necessary for the rapid introduction of the single currency is available as a legal basis only when it has been confirmed, in accordance with Article 109j (4) of the Treaty, which Member States fulfil the necessary conditions for the adoption of a single currency; whereas it is therefore necessary to have recourse to Article 235 of the Treaty as a legal basis for those provisions where there is an urgent need for legal certainty; whereas therefore this Regulation and the aforesaid Regulation on the introduction of the euro will together provide the legal framework for the euro, the principles of which legal framework were agreed by the European Council in Madrid; whereas the introduction of the euro concerns day-to-day operations of the whole population in participating Member States; whereas measures other than those in this Regulation and in the Regulation which will be adopted under the third sentence of Article 109l (4) of the Treaty should be examined to ensure a balanced changeover, in particular for consumers;
(5) Overwegende dat artikel 109 L, lid 4, derde zin, van het Verdrag, waarbij de Raad de mogelijkheid krijgt met eenparigheid van stemmen van de deelnemende lidstaten de overige maatregelen die nodig zijn voor de spoedige invoering van de enige munteenheid te nemen, pas als rechtsgrondslag kan dienen, zodra overeenkomstig artikel 109 J, lid 4, van het Verdrag, bevestigd is welke lidstaten voldoen aan de nodige voorwaarden voor de aanneming van één munt; dat derhalve artikel 235 als rechtsgrondslag moet worden gebruikt voor de bepalingen ten aanzien waarvan dringend behoefte bestaat aan rechtszekerheid; dat derhalve de onderhavige verordening en de verordening over de invoering van de euro tezamen het rechtskader voor de euro vormen, waarvan de beginselen zijn vastgesteld door de Europese Raad van Madrid; dat de invoering van de euro gevolgen heeft voor de dagelijkse verrichtingen van de gehele bevolking van de deelnemende lidstaten; dat nog andere maatregelen dan die welke zijn vastgesteld in deze verordening en in de verordening die aangenomen wordt uit hoofde van artikel 109 L, lid 4, derde zin, van het Verdrag, bezien moeten worden teneinde met name voor de consument een evenwichtige overgang te waarborgen;

Given the often considerable structural differences between Member States' constitutions and legal systems, the Commission has refrained from proposing harmonised changeover measures for national public administrations, except for the two regulations which form the legal framework for the euro.
