smart grids, defined as any equipment, line, cable or installation, both at transmission and low and medium voltage distribution level, aiming at two-way digital communication, real-time or close to real-time, interactive and intelligent monitoring and management of electricity generation, transmission, distribution and consumption within an electricity network in view of developing a network efficiently integrating the behaviour and actions of all users connected to it — generators, consumers and those that do both — in order to ensure an economically efficient, sustainable electricity system with low losses and high quality and security of supply and safety;

Article 3 of the 1990 Law assigned France Télécom a mandate: (i) to provide all national and international public telecommunications services; (ii) to establish, develop and operate the public networks necessary for supplying these services and to ensure their connection to foreign networks; (iii) to provide all other telecommunications services, installations and networks, and to establish networks distributing radio and television broadcasting services by cable.

Articles 2(a), 8 and 12 of Directive 2002/19/EC of the European Parliament and of the Council of 7 March 2002 on access to, and interconnection of, electronic communications networks and associated facilities (Access Directive), as amended by Directive 2009/140/EC of the European Parliament and of the Council of 25 November 2009, must be interpreted as meaning that the national regulatory authority has the power to impose on an electronic communications operator that has significant market power on a specific market, pursuant to the obligation to meet reasonable requests for access to, and use of, specific network elements and associated facilities, an obligation to install, at the request of competing operators, a drop cable not exceeding 30 metres in length connecting the distribution frame of an access network to the network termination point at the end-user’s premises, as long as that obligation is based on the nature of the problem identified, proportionate and justified in the light of the objectives set out in Article 8(1) of Directive 2002/21/EC of the European Parliament and of the Council of 7 March 2002 on a common regulatory framework for electronic communications networks and services (Framework Directive), as amended by Directive 2009/140, which is a matter for the referring court to verify.
De artikelen 2, sub a, 8 en 12 van richtlijn 2002/19/EG van het Europees Parlement en de Raad van 7 maart 2002 inzake de toegang tot en interconnectie van elektronischecommunicatienetwerken en bijbehorende faciliteiten (Toegangsrichtlijn), zoals gewijzigd bij richtlijn 2009/140/EG van het Europees Parlement en de Raad van 25 november 2009, moeten aldus worden uitgelegd dat de nationale regelgevende instantie bevoegd is om een elektronischecommunicatie-exploitant met een aanmerkelijke macht op een specifieke markt krachtens de verplichting om in te gaan op redelijke verzoeken om toegang tot en gebruik van bepaalde netwerkelementen en bijbehorende faciliteiten, een verplichting tot aanleg op verzoek van concurrerende exploitanten van een bijzondere aftakking van niet meer dan 30 meter lang tussen het verdeelpunt in een toegangsnetwerk en het netwerkaansluitpunt bij de eindgebruiker op te leggen, wanneer deze verplichting is gebaseerd op de aard van het geconstateerde probleem en in het licht van de doelstellingen van artikel 8, lid 1, van richtlijn 2002/21/EG van het Europees Parlement en de Raad van 7 maart 2002 inzake een gemeenschappelijk regelgevingskader voor elektronischecommunicatienetwerken en -diensten (Kaderrichtlijn), zoals gewijzigd bij richtlijn 2009/140, proportioneel en gerechtvaardigd is, wat de verwijzende rechter dient na te gaan.
