IN-CONTEXT TRANSLATIONS

With a view to ensuring equal treatment for all applicants and beneficiaries of international protection, as well as in order to ensure consistency with the current Union asylum acquis, in particular with Directive 2011/95/EU of the European Parliament and of the Council of 13 December 2011 on standards for the qualification of third-country nationals or stateless persons as beneficiaries of international protection, for a uniform status for refugees or for persons eligible for subsidiary protection, and for the content of the protection granted and Regulation (EU) No 604/2013, it is appropriate to extend the scope of this Regulation in order to include applicants for subsidiary protection and persons eligible for subsidiary protection.
Om ervoor te zorgen dat alle personen die om internationale bescherming verzoeken of internationale bescherming genieten, gelijk worden behandeld en om te zorgen voor samenhang met het huidige Unie-acquis inzake asiel, met name met Richtlijn 2011/95/EU van het Europees Parlement en de Raad van 13 december 2011 inzake normen voor de erkenning van onderdanen van derde landen of staatlozen als personen die internationale bescherming genieten, voor een uniforme status voor vluchtelingen of voor personen die in aanmerking komen voor subsidiaire bescherming, en voor de inhoud van de verleende bescherming en met Verordening (EU) nr. 604/2013, dient de werkingssfeer van deze verordening te worden uitgebreid tot personen die om subsidiaire bescherming verzoeken en personen die voor subsidiaire bescherming in aanmerking komen.

47. Calls on the Commission to take into consideration, in its legislative proposal for a permanent and effective intra-EU Relocation Mechanism, the use of an EU Distribution Key for the relocation of beneficiaries of international protection, based on appropriate indicators relating to Member States' reception and integration capacities, such as Member States' GDP, population and surface area and beneficiaries' best interest and integration prospects; this EU Distribution Key could be taken into account for Member States which are facing specific and disproportionate pressures on their national asylum systems or during emergency situations; underlines that relocation will always depend on the consent of beneficiaries of international protection and that the introduction of an EU Distribution Key would be without prejudice to each Member State's obligation to implement and apply the existing EU asylum acquis in terms of qualification for protection, reception conditions and procedural guarantees, and to adhere to all international obligations in this field;
47. verzoekt de Commissie om in haar wetgevingsvoorstel voor een permanent en doeltreffend intern EU-overbrengingsmechanisme het gebruik van een EU-verdeelsleutel voor de overbrenging van personen die internationale bescherming genieten in overweging te nemen, gebaseerd op toepasselijke indicatoren inzake de opvang- en integratiecapaciteiten van de lidstaten zoals het bbp, de bevolking en de oppervlakte alsook de belangen van de begunstigden en de integratieperspectieven; meent dat deze EU-verdeelsleutel in aanmerking kan worden genomen voor lidstaten die geconfronteerd worden met specifieke en onevenredige druk op hun asielstelsels of in noodsituaties; onderstreept dat overbrenging altijd afhankelijk is van de instemming van degenen die internationale bescherming genieten en dat de invoering van een EU-verdeelsleutel geen afbreuk mag doen aan de verplichting van elke lidstaat om het bestaand Europees asielacquis inzake erkenning als beschermingsbehoeftige, de voorwaarden voor opvang en de procedurele waarborgen uit te voeren en toe te passen en alle internationale verplichtingen op dit gebied na te leven;

133. By derogation to paragraphs 1, 2 and 3 of this Article, Member States may decide that the refugee ð international protection ï status shall lapse by law in case of cessation in accordance with Article 11(1)(a) to (d) of Directive 2004/83/EC or if the refugee ð beneficiary of international protection ï has unequivocally renounced his/her recognition as a refugee ð beneficiary of international protection ï.
133. 2. While allowing for national dispersal practice of beneficiaries of international protection, Member States shall endeavour to implement policies aimed at preventing discrimination of beneficiaries of international protection and at ensuring equal opportunities regarding access to accommodation.
2. De lidstaten spannen zich in, onverminderd de ruimte die wordt gelaten voor nationale spreiding van de personen die internationale bescherming genieten, een beleid te voeren dat erop gericht is discriminatie van personen die internationale bescherming genieten, te voorkomen en hun op het gebied van toegang tot huisvesting gelijke kansen te bieden.

(36a) When deciding on entitlements to the benefits included in this Directive, Member States should take due account of the best interests of the child as well as of the particular circumstances of the dependency on the beneficiary of international protection of close relatives who are already present in the Member State and who are not family members of beneficiaries of international protection.
(36 bis) Bij besluiten over het recht op de voorzieningen uit hoofde van deze richtlijn, moeten de lidstaten terdege rekening houden met het belang van het kind en met de bijzondere omstandigheden die bestaan in geval van afhankelijkheid van de persoon die internationale bescherming geniet van naaste verwanten die reeds in de lidstaat aanwezig zijn en die geen familieleden van personen die internationale bescherming genieten zijn.

Where the expulsion of a beneficiary of international protection outside the territory of the Union is permitted under Directive 2004/83/EC, Member States should be obliged to ensure that all information is obtained from relevant sources, including, where appropriate, from the Member State that granted international protection, and that it is thoroughly assessed with a view to guaranteeing that the decision to expel that beneficiary is in accordance with Article 4 and Article 19(2) of the Charter of Fundamental Rights of the European Union.
Indien de verwijdering van een persoon die internationale bescherming geniet buiten het grondgebied van de Unie is toegestaan uit hoofde van Richtlijn 2004/83/EG, moeten de lidstaten verplicht worden ervoor te zorgen dat alle informatie van de relevante bronnen wordt verkregen, met inbegrip, waar nodig, van de lidstaat die internationale bescherming heeft verleend, en dat deze informatie terdege wordt geëvalueerd ten einde te waarborgen dat het besluit tot verwijdering van die persoon strookt met artikel 4 en artikel 19, lid 2, van het Handvest van de grondrechten van de Europese Unie.

In view of the right of beneficiaries of international protection to reside in Member States other than the one which granted them international protection, it is necessary to ensure that those other Member States are informed of the protection background of the persons concerned to enable them to comply with their obligations regarding the principle of non-refoulement.
Indien personen die internationale bescherming genieten het recht krijgen om in andere lidstaten dan de lidstaat die hun internationale bescherming heeft verleend te verblijven, is het noodzakelijk er voor te zorgen dat deze andere lidstaten op de hoogte zijn van de beschermingsachtergrond van de betrokken personen, zodat zij hun verplichtingen in verband met het beginsel van non-refoulement kunnen naleven.

Council Directive 2003/109/EC of 25 November 2003 concerning the status of third-country nationals who are long-term residents does not apply to beneficiaries of international protection as defined in Council Directive 2004/83/EC of 29 April 2004 on minimum standards for the qualification and status of third-country nationals or stateless persons as refugees or as persons who otherwise need international protection and the content of the protection granted

"Regarding beneficiaries of international protection, the period between the date on which the first application for international protection is lodged, including where the first application is an application for temporary protection where temporary protection precedes access to international protection, and the date on which the residence permit referred to in Article 24 of Directive 2004/83/EC is granted shall be taken into account in the calculation of the period referred to in paragraph 1".
