2. Deplores the fact that the VNP has also become one of the most dangerous places in the world when it comes to wildlife conservation; notes with deep concern that armed groups have been involved in illegal exploitation of the park’s natural resources through mining activities and charcoal production used both to sustain their military operations and for personal gain; deplores, also, the fact that armed groups have been involved in large-scale poaching for food purposes and for war-sustaining trade in ivory and bush meat; notes with concern, furthermore, that poor discipline, irregular pay and lack of food have resulted in military personnel becoming increasingly involved in illegal activities, including artisanal mining, charcoal production and wildlife poaching; notes that while the park is an area of great wilderness, its two million acres (790 000 hectares) have huge protection problems, especially with limited government funding; notes that on 15 April 2014 the Chief Warden of the Park, Belgian Prince Emmanuel de Merode, was seriously injured by three gunmen and that more than 140 rangers have been killed in the park on active service in the past decade;
2. betreurt dat het VNP ook tot een van de gevaarlijkste plaatsen ter wereld is geworden waar het gaat om natuurbescherming (voornamelijk dieren in het wild); stelt met grote bezorgdheid vast dat gewapende groepen betrokken zijn bij de illegale exploitatie van de natuurlijke rijkdommen van het park en dat ze door grondstoffendelving en houtskoolwinning enerzijds hun militaire activiteiten financieren en anderzijds zich persoonlijk verrijken; betreurt ook dat gewapende groepen zich op grote schaal met stroperij bezighouden voor voeding en voor de handel in ivoor en bushmeat, waarmee de oorlog wordt gefinancierd; stelt daarnaast met bezorgdheid vast dat militairen zich door een gebrek aan discipline, onregelmatige uitbetaling van lonen en voedseltekort ook steeds meer inlaten met illegale activiteiten, zoals ambachtelijke mijnbouw, houtskoolwinning en stroperij; overwegende dat het park gekenmerkt wordt door veel ongerepte natuur en het zeer moeilijk is om het oppervlak van 790 000 hectare te beschermen, vooral gezien het feit dat de regering hiervoor slechts in beperkte mate financiële middelen uittrekt; overwegende dat de hoofdopzichter van het park, de Belgische prins Emmanuel de Merode, op 15 april 2014 door drie schutters ernstig werd verwond, en dat de afgelopen tien jaar meer dan 140 opzichters in actieve dienst in het park om het leven zijn gebracht;

Article 2(1) of Directive 2003/88/EC of the European Parliament and of the Council of 4 November 2003 concerning certain aspects of the organisation of working time must be interpreted as meaning that a period during which a forest ranger, whose daily working time, as stipulated in his employment contract, is eight hours, is required to carry out wardenship duties in a section of forest, making him liable to disciplinary action, the payment of compensation and civil or criminal sanctions, as the case may be, for any damage ascertained in the area under his control, regardless of the time when the damage occurs, constitutes ‘working time’ within the meaning of that provision only if the nature and extent of the wardenship obligation on that forest ranger and the system of liability applicable to him require his physical presence at the place of work and if, during that period, he must be available to his employer.
Artikel 2, sub 1, van richtlijn 2003/88/EG van het Europees Parlement en de Raad van 4 november 2003 betreffende een aantal aspecten van de organisatie van de arbeidstijd moet aldus worden uitgelegd dat de tijd waarin een boswachter wiens dagelijkse arbeidstijd volgens zijn individuele arbeidsovereenkomst 8 uur bedraagt, verplicht is een perceel bos te bewaken, met betrekking tot hetwelk hij, naargelang van het geval, tuchtrechtelijk, vermogensrechtelijk, boeterechtelijk of strafrechtelijk aansprakelijk is voor de schade die zich voordoet in het onder zijn beheer staande perceel, ongeacht wanneer deze schade is ontstaan, alleen dan „arbeidstijd” in de zin van deze bepaling vormt indien de aard en de omvang van de op de boswachter rustende bewakingsverplichting en de voor hem geldende aansprakelijkheidsregeling vereisen dat hij fysiek aanwezig is op de arbeidsplaats en hij er zich tijdens die tijd ter beschikking moet houden van zijn werkgever.
