27. Reiterates its call on the authorities to continue their efforts to eliminate the legacy of the former Communist secret services, as a step towards the democratisation of Serbia; calls on Serbia to intensify the process of succession and implementation of obligations relating to the division of property, and the agreement on the division of the common archive of the former Yugoslavia; reiterates, in this connection, that full access to all archival materials, especially those of the former Yugoslav Secret Services (UDBA), is of vital significance; reiterates its call to the authorities to facilitate access to those archives that concern the former republics of Yugoslavia and to return them to their respective governments if they so request;

The proposal in fact provides for limited amendments to the existing regulation, such as the obligation for each EU institution (except the Court of Justice and the European Central Bank) to deposit at the EUI its historical archives, the principle that each institution shall maintain the ownership of its archives, the system for financing the archives, the protection of personal data contained in the archives, and the making available of the archives by electronic means, wherever possible.

The amendments contained in this opinion aim in the first place to clarify and emphasise the functional coherence between the regulation on the archives and Regulation No 1049/2001 as far as the aspect of access to documents and possible limits to it is concerned. The Commission proposal does not do enough to prevent misunderstandings on behalf of the public but also on behalf of officials of the institutions, misunderstandings in the sense that access to documents in historical archives would be subject to special rules or a "special access regime".
