Council Regulation (EC) No 1085/2006 established an Instrument for Pre-Accession Assistance (IPA), Regulation (EC) No 1638/2006 of the European Parliament and of the Council established a European Neighbourhood and Partnership Instrument, Regulation (EC) No 1905/2006 of the European Parliament and of the Council established a financing instrument for development cooperation, Council Regulation (EC) No 1934/2006 established a financing instrument for cooperation with industrialised and other high-income countries and territories and the Partnership Agreement between the members of the African, Caribbean and Pacific Group of States and the European Community and its Member States, signed in Cotonou on 23 June 2000 (the ACP-EC Partnership Agreement) and the Internal Agreement establishing the financing of Community aid under the multiannual financial framework for the period 2008 to 2013 in accordance with the ACP-EC Partnership Agreement and the allocation of financial assistance for the Overseas Countries and Territories to which Part Four of the EC Treaty applies (Internal ACP-EC Agreement), govern the European Development Fund.

Under the ACP-EC Partnership Agreement, ACP States party to previous ACP-EC Conventions which, in the absence of normally established government institutions, have not been able to sign or ratify the ACP-EC Partnership Agreement, may nevertheless be accorded special support.

An important aspect of the Council's agreement is a commitment to earmark a substantial share of the "aid for trade" effort to support economic partnership agreements currently being negotiated with the 79 African, Caribbean and Pacific (ACP) states with whom the EU has concluded the ACP-EU partnership agreement ("Cotonou agreement") until 2020.

Pursuant to Article 1(1) of Protocol 3 on ACP sugar (hereinafter referred to as the ACP Protocol) attached to Annex V to the Partnership Agreement between the members of the African, Caribbean and Pacific Group of States, of the one part, and the European Community and its Member States, of the other part, signed in Cotonou on 23 June 2000 (hereinafter referred to as the ACP-EC Partnership Agreement), and Article 1(1) of the Agreement between the European Economic Community and the Republic of India on cane sugar (hereinafter referred to as the Agreement with India), the Community undertakes to purchase and import, at guaranteed prices, specific quantities of cane sugar which originate in the ACP States and India respectively and which those States undertake to deliver to it.

The European Union recalls its long-standing cooperation with the Pacific ACP countries in the framework of the ACP/EU Partnership Agreement and reaffirms its ambition of strengthening the partnership between the European Union and the Pacific region.

Annex Ia to the ACP-EC Partnership Agreement concerning the multiannual financial framework of cooperation under the ACP-EC Partnership Agreement for the period after the Ninth European Development Fund (EDF) states that the European Union shall maintain its aid effort to ACP States under the ACP-EC Partnership Agreement at least at the same level as that of the Ninth EDF, also adding the effects of inflation, growth within the EU and enlargement to 10 new Member States in 2004, but does not specify the exact period covered (five or six years), the amount or the financing instrument (general budget or new EDF).
In bijlage I bis van de ACS-EG-partnerschapsovereenkomst, die betrekking heeft op het meerjarig financieel kader voor de samenwerking in het kader van de herziene ACS-EG-overeenkomst na afloop van het negende Europees Ontwikkelingsfonds (hierna „EOF” genoemd), is bepaald dat de Europese Unie haar steuninspanningen ten gunste van de ACS-staten in het kader van de herziene ACS-EG-partnerschapsovereenkomst handhaaft op ten minste hetzelfde peil als dat van het negende EOF waaraan het effect van de inflatie, de groei in de Europese Unie en de uitbreiding met tien nieuwe lidstaten in 2004 worden toegevoegd, maar wordt niets gezegd over de exacte looptijd (vijf of zes jaar), het bedrag of het financieringsinstrument (algemene begroting of nieuw EOF).

The Council adopted a Decision authorising the Commission to negotiate with the ACP States referred to in Protocol No 3 annexed to the ACP-EC Partnership Agreement and with India an agreement on the conditions for access to a tariff quota for raw cane sugar to be refined opened by the Community in favour of those States.
