In order to take account of the special situation which has existed until now in the United Kingdom, namely the exemption of imports of works of art acquired prior to 1973, the agreement reached on Monday enables that country to apply an effective VAT rate of 2.5% to such imports of works of art during the period in which the transitional VAT arrangements are in force but not later than 30 June 1999.

Germany has been granted a temporary derogation from the provisions of the Seventh Directive: for purely domestic transactions in works of art, that country will, during the period in which the transitional VAT arrangements are in force but not later than 30 June 1999, be able to apply the normal arrangements for taxation of the full value at the reduced rate applicable there (7%). 3. Rules on imports of works of art, antiques, etc. The Directive also lays down common rules for taxing imports of works of art, collectors' items and antiques into the Community.

For such imports, Member States are able to apply a reduced rate of at least 5% or a taxable amount reduced in such as way that the tax is equal to at least 5%, instead of the standard rate of VAT. Exports from the European Union to third countries are exempt from VAT. 7. In order to take account of the special situation which existed until now in the United Kingdom, namely the exemption of imports of works of art dating from before 1973, the Directive allows that country to apply an effective extra-low rate of 2.5% to such imports during the period in which the transitional VAT arrangements are in force and until not later than 30 June 1999.

Germany has been granted a temporary derogation from this harmonized system: for works of art, that country will be able to go on applying the normal arrangements for taxation on the entire value at the reduced rate applicable in Germany, during the period in which the transitional VAT arrangements are in force but not later than 30 June 1999.
