TRADUCTIONS EN CONTEXTE

On a proper construction of Article 65 of Directive 2001/82/EC and Article 16 of Directive 2006/123/EC (2) (the ‘services’ Directive), is a Member State entitled not to recognise authorisations for the wholesale distribution of veterinary medicinal products that are issued by the competent authorities of other Member States to their own nationals and to require that those nationals additionally hold wholesale distribution authorisations issued by its own competent authorities in order to be entitled to apply for and to use authorisations for the parallel importation of veterinary medicinal products within that Member State?
Volgt uit de bepalingen vervat in artikel 65 van richtlijn 2001/82/EG en artikel 16 van de „dienstenrichtlijn” 2006/123/EG (2) dat een lidstaat gerechtigd is om door de bevoegde autoriteiten van andere lidstaten aan hun eigen onderdanen verleende groothandelsvergunningen voor geneesmiddelen voor diergeneeskundig gebruik niet te erkennen, en om te verlangen dat deze onderdanen daarnaast beschikken over een groothandelsvergunning van de bevoegde nationale autoriteiten van deze lidstaat zelf, teneinde in die lidstaat vergunningen te kunnen aanvragen en gebruiken voor parallelinvoer van geneesmiddelen voor diergeneeskundig gebruik?

For the purpose of point (b), in the case where the product is obtained from another wholesale distributor, holders of the wholesale distribution authorisation must verify compliance with good distribution practices of the supplying wholesale distributor and check that the latter holds a wholesale distribution authorisation.
Voor de toepassing van punt b) moet de houder van een groothandelsvergunning, wanneer het geneesmiddel bij een andere groothandelaar betrokken wordt, controleren of de leverende groothandelaar zich houdt aan goede distributiepraktijken en of hij houder van een groothandelsvergunning is.

For the purpose of point (b), in the case where the product is obtained from another wholesale distributor, holders of the wholesale distribution authorisation must verify compliance with good distribution practices of the supplying wholesale distributor either by themselves or through a body accredited for that purpose by the competent authority of a Member State, including checking that the latter is an authorised wholesale distributor through the Community database, as referred to in Article 111(6).

Member States shall take all appropriate measures to ensure that the wholesale distribution, trade and brokering of medicinal products is subject to the possession of an authorization to engage in activity as a wholesaler, trader or broker in medicinal products, stating the place for which it is valid.

De lidstaten nemen de nodige maatregelen om te bewerkstelligen dat de groothandel, handel en tussenhandel in geneesmiddelen wordt onderworpen aan het bezit van een vergunning voor het uitoefenen van de activiteit van groothandelaar, handelaar of tussenhandelaar in geneesmiddelen, waarin de plaats waarvoor die vergunning geldt, wordt vermeld.

Wholesale distribution, if not conducted by the marketing authorisation holder, requires a wholesale distribution authorisation.

- wholesale distribution of medicinal products shall mean all activities consisting of procuring, holding, supplying or exporting medicinal products, apart from supplying medicinal products to the public; such activities are carried out with manufacturers or their depositories, importers, other wholesale distributors or with pharmacists and persons authorized or entitled to supply medicinal products to the public in the Member State concerned,
- "groothandel in geneesmiddelen": iedere activiteit die erin bestaat geneesmiddelen aan te schaffen, te houden, te leveren of uit te voeren, uitgezonderd het afleveren van geneesmiddelen aan het publiek; deze activiteiten vinden plaats met fabrikanten of hun depothouders, importeurs, andere groothandelaars of met apothekers en personen die in de betrokken Lid-Staat gemachtigd of gerechtigd zijn geneesmiddelen aan het publiek af te leveren;

Whereas the wholesale distribution of medicinal products is at present subject to different provisions in the various Member States; whereas many operations involving the wholesale distribution of medicinal products for human use may cover several Member States simultaneously;
Overwegende dat de groothandel in geneesmiddelen voor menselijk gebruik thans nog is onderworpen aan voorschriften die van Lid-Staat tot Lid-Staat verschillen; dat talrijke groothandelsverrichtingen op geneesmiddelengebied echter gelijktijdig verscheidene Lid-Staten kunnen bestrijken;
