TRADUCTIONS EN CONTEXTE

For the purpose of the inquiry the key areas were grouped under the following headings: (1) market concentration/market power, (2) vertical foreclosure (most prominently inadequate unbundling of network and supply), (3) lack of market integration (including lack of regulatory oversight for cross border issues), (4) lack of transparency, (5) price formation, (6) downstream markets, (7) balancing markets, and (8) liquefied natural gas (LNG).

I welcome the proposal for the new network, but what we need is an effective network, a network that will stamp out the trafficking once and for all, because Europe is wide open in terms of open boundaries and open borders, so we really need to get our act together, and I commend the Council’s determination.

In an open, competitive market, transmission system operators should be compensated for costs incurred as a result of hosting cross-border flows of electricity on their networks by the operators of the transmission systems from which cross-border flows originate and the systems where those flows end.

Within two months from the day of receipt, the Agency shall provide a duly reasoned opinion as well as recommendations to the ENTSO for Electricity and to the Commission where it considers that the draft annual work programme or the draft Community-wide network development plan submitted by the ENTSO for Electricity do not contribute to non-discrimination, effective competition, the efficient functioning of the market or a sufficient level of cross-border interconnection open to third-party access.

4. The Agency shall, based on matters of fact, provide a duly reasoned opinion as well as recommendations to the ENTSO for Electricity, the ENTSO for Gas, the European Parliament, the Council and the Commission, where it considers that the draft annual work programme or the draft non-binding 10-year network development plan submitted to it in accordance with the second subparagraph of Article 9(2) of Regulation (EC) No ./2009 [on conditions for access to the network for cross-border exchanges in electricity] and the second subparagraph of Article 9(2) of Regulation (EC) No ./2009 [on conditions for access to the natural gas transmission networks] do not contribute to non-discrimination, effective competition and the efficient functioning of the market or a sufficient level of cross-border interconnection open to third-party access, or are not in compliance with the relevant provisions of Regulation (EC) No ./2009 [on conditions for access to the network for cross-border exchanges in electricity] and Regulation (EC) No ./2009 [on conditions for access to the natural gas transmission networks] or Directive 2009/./EC [concerning common rules for the internal market in electricity] and Directive 2009/./EC [concerning common rules for the internal market in natural gas].
4. The technical functionalities of the network for consulting the central visa authorities as laid down in Article 17(2) of the Convention implementing the Schengen Agreement of 14 June 1985 between the Governments of the States of the Benelux Economic Union, the Federal Republic of Germany and the French Republic on the gradual abolition of checks at their common borders (the Schengen Convention) should be integrated into the VIS.

The Commission is in any event calling, on the basis of studies commissioned by it, for priority to be given in passenger transport to progressive opening up of the network in three stages. That approach would provide initially for the full opening up of the market in niches providing regular services (night trains and car trains, with cabotage options), then an opening up of all cross-border connections, including long-distance and high-speed trains, without a cabotage option, and finally the complete liberalisation of all cross-border connections, including cabotage options.

The objective of the action programme, known as ARGO, is to reinforce the effectiveness of the relevant procedures in the fields of asylum, visas, immigration and the control of external borders and assist the national administrations in the implementation of the Community legislation based on Articles 62 and 63 of the EC Treaty, as well as to ensure openness in the application of this legislation.
