The term ‘assets’ includes: (i) all tangible and intangible assets that will be transferred to the joint venture (examples of tangible assets include production plants, wholesale or retail outlets, and inventory of goods; examples of intangible assets include intellectual property, goodwill, etc.), and (ii) any amount of credit or any obligations of the joint venture which any parent company of the joint venture has agreed to extend or guarantee.
Onder „activa” moet worden verstaan: 1) alle materiële en immateriële activa die aan de gemeenschappelijke onderneming zullen worden overgedragen (tot de materiële activa behoren onder meer de productie-installaties, de afzetvoorzieningen voor groot- en kleinhandel, en de voorraden; tot de immateriële activa behoren onder meer intellectuele-eigendomsrechten en goodwill), en 2) alle leningen of verplichtingen van de gemeenschappelijke onderneming die een moedermaatschappij van de gemeenschappelijke onderneming heeft aanvaard te verstrekken of te waarborgen.

The opening of insolvency proceedings shall not affect the rights in rem of creditors or third parties in respect of tangible or intangible, moveable or immoveable assets, both specific assets and collections of indefinite assets as a whole which change from time to time, belonging to the debtor which are situated within the territory of another Member State at the time of the opening of proceedings.

Where financial instruments support financing to enterprises, including SMEs, such support shall target the establishment of new enterprises, early stage-capital, i.e., seed capital and start-up capital, expansion capital, capital for the strengthening of the general activities of an enterprise, or the realisation of new projects, penetration of new markets or new developments by existing enterprises, without prejudice to applicable Union State aid rules and in accordance with Fund-specific rules. Support may include investment in both tangible and intangible assets as well as working capital within the limits of applicable Union State aid rules and with a view to stimulating the private sector as a supplier of funding to enterprises.
3 bis. ‘tangible assets’ means, without prejudice to Article 17(12), assets relating to land, buildings and plant, machinery and equipment; in the transport sector transport means and transport equipment are considered eligible assets, except with regard to regional aid and except for road freight and air transport.
„materiële activa”: onverminderd artikel 17, punt 12, activa met betrekking tot gronden, gebouwen en installaties, machines en uitrusting.
