To mitigate the consequences of this regime, Denmark has requested authorisation to apply a special measure derogating from Article 75 of Directive 2006/112/EC as previously granted by Council Implementing Decision 2012/447/EU (2), which expired 31 December 2014.
Om de gevolgen van deze regeling te verzachten heeft Denemarken toestemming gevraagd om een speciale maatregel toe te passen waarbij wordt afgeweken van artikel 75 van Richtlijn 2006/112/EG, welke voorheen werd verleend bij Uitvoeringsbesluit 2012/447/EU van de Raad (2), die op 31 december 2014 is verstreken.

By notification registered at the Commission on 27 November 2013, Hungary requested authorisation to introduce a Quick Reaction Mechanism special measure derogating from Article 193 of Directive 2006/112/EC.

In order to ensure that the special measure only applies to certain specific agricultural products and to guarantee its legal certainty, the goods covered by the special measure should be determined by using the combined nomenclature laid down in Council Regulation (EEC) No 2658/87 of 23 July 1987 on the tariff and statistical nomenclature and on the Common Customs Tariff (2).
Opdat deze bijzondere maatregel uitsluitend van toepassing zou zijn op een aantal welomschreven landbouwproducten en de rechtszekerheid niet in het gedrang zou komen, moet de gecombineerde nomenclatuur die is vastgesteld bij Verordening (EEG) nr. 2658/87 van de Raad van 23 juli 1987 met betrekking tot de tarief- en statistieknomenclatuur en het gemeenschappelijk douanetarief (2), worden gebruikt om de producten waarop de bijzondere maatregel ziet, te omschrijven.

F. whereas Article 23(1) and (3) of Regulation (EC) No 1905/2006 stipulate respectively that (Article 23(1)) "in the event of unforeseen and duly justified needs or circumstances related to natural disasters, civil strife or crises, and which cannot be funded under Regulation (EC) No 1717/ 2006 or Regulation (EC) No 1257/96, the Commission shall adopt special measures not provided for in the strategy papers or multiannual indicative programmes (hereinafter referred to as "special measures")", that "special measures may also be used to fund measures to ease the transition from emergency aid to long-term development operations including those to better prepare people to deal with recurring crises", and that (Article 23 (3)) "where the cost of such measures exceeds EUR 10 million, the Commission shall adopt them under the management procedure referred to in Article 35(2)",

2. Takes the view that, in the draft Special Measure for Iraq for 2007, the Commission exceeds the implementing powers laid down in Regulation (EC) No 1905/2006 by selecting as one of the areas of intervention a "Feasibility Study for the Akkas Gas Field", the overall objective of which is "to study the conditions for exploration of the Akkas Gas Field in western Iraq in view of linking its output to the Syrian gas pipeline network", and further "to integrate this project if possible in the workings of the Euro-Arab Mashreq Gas Market Project"; points out that "the study will take into consideration the future interest of the Mashreq neighbours and of the EU in integrating the output of the wells into the Euro-Mashreq gas market", and that "this integration will open a large potential market for the Akkas fields' production and allow a first integration of the Iraq natural gas with the regional and European market", and therefore considers that this objective is not in compliance with Article 2(1) and (4) of Regulation (EC) No 1905/2006, in that the primary objective of the proposed Special Measures is not the eradication of poverty and in that the stated objectives do not fulfil the criteria for ODA established by the OECD/DAC;
2. is van mening dat de Commissie in het ontwerp van bijzondere maatregel voor Irak voor 2007 de in Verordening (EG) nr. 1905/2006het basisbesluit bedoelde uitvoeringsbevoegdheden overschrijdt door als een van de gebieden waarop dienen maatregelen te worden genomen het "Haalbaarheidsonderzoek voor het Akkas-aardgaswinningsveld" te kiezen, dat als algemeen doel heeft "de voorwaarden te bestuderen voor de exploratie van het Akkas-gaswinningsveld in West-Irak om de productie daarvan aan het Syrische netwerk van gaspijpleidingen te koppelen" en verder "dit project zo mogelijk te integreren in het functioneren van het Euro-Arabische Mashrek-gasmarktproject"; wijst erop dat "bij de studie rekening zal worden gehouden met de toekomstige belangen van de naburige Mashrek-landen en van de EU door integratie van de productie van de gasbronnen in de Euro-Arabische Mashrek-gasmarkt" en dat "deze integratie een grote potentiële markt zal ontsluiten voor de productie van het Akkas-veld en zal leiden tot een eerste integratie van het Iraakse aardgas op de regionale en Europese markt"; en is van oordeel dat dit doel derhalve niet strookt met het bepaalde in artikel 2, leden 1 en 4, van Verordening (EG) nr. 1905/2006, aangezien het primaire doel van de voorgestelde bijzonder maatregelen niet de uitbanning van armoede is en aangezien de vermelde doelstellingen niet voldoen aan de criteria voor ODA welke door de OECD/DAC zijn vastgesteld;

2. Where the officer conducting the certificate verification referred to in paragraph 1 has clear grounds for believing that the ship is not in compliance with the requirements of the special measures to enhance maritime security of the SOLAS Convention and of the ISPS Code, but does not belong to an authority which in that Member State is responsible for carrying out the measures provided for in paragraphs 1.2 and 1.3 of regulation 9 of the special measures to enhance maritime security of the SOLAS Convention, s/he shall immediately refer the matter to the said authority.
2. Wanneer de ambtenaar die de in lid 1 bedoelde certificaatcontrole uitvoert ernstige redenen heeft om aan te nemen dat het schip niet voldoet aan de voorschriften van de speciale maatregelen ter verbetering van de maritieme beveiliging van het SOLAS-Verdrag of de ISPC-code, maar niet ressorteert onder een autoriteit die in de betreffende lidstaat bevoegd is voor de uitvoering van de maatregelen welke zijn voorzien in de paragrafen 1.2 en 1.3 van voorschrift 9 van de speciale maatregelen ter verbetering van de maritieme beveiliging van het SOLAS-Verdrag wendt hij zich onverwijld tot genoemde autoriteit.

1. When a ship which is subject to the requirements of the special measures to enhance maritime security of the SOLAS Convention and of the ISPS Code or of Article 3 of this Regulation announces its intention to enter a port of a Member State, the competent authority for maritime security of that Member State shall require that the information referred to in paragraph 2.1 of regulation 9 (Ships intending to enter a port of another Contracting Government) of the special measures to enhance maritime security of the SOLAS Convention be provided.

In Article 2, the following new indents are inserted after the seventh indent: "- special measures when exceptional disasters, particularly natural disasters, are determined to have occurred; - local partnerships between the public, private or voluntary sector, whose aim it is to facilitate the implementation of one or more of the measures within this Article; - capacity development among the actors in the local authorities or non-governmental organisations who are committed to the furtherance of other measures within this Article; "

The proposal does not provide for the inclusion in the programme of additional special measures eligible for support alongside the 15 existing sets of measures. European Community support should instead involve a lessening of the financial burden for the recipient and the candidate countries.
Het is de bedoeling om naast de bestaande vijftien maatregelenpakketten van SAPARD niet nog eens extra maatregelen in het programma op te nemen, maar om de steun van de Europese Gemeenschap via vermindering van de financiële belasting voor de ontvangers en de kandidaat-landen te laten plaatsvinden.
