29. By letter of 12 April 2002 the Secretary-General of the Parliament (‘the Secretary-General’) reminded the applicant of the various allowances that had been paid to him since the beginning of his term of office and asked him to provide, by the end of April 2002, facts and figures on the use of the credits paid as secretarial allowances between 1999 and 31 January 2001 and details on the use of credits paid as general expenditure allowances.
29 Bij brief van 12 april 2002 heeft de secretaris-generaal van het Parlement (hierna: „secretaris-generaal”) verzoeker herinnerd aan de verschillende vergoedingen die hem sinds het begin van zijn mandaat zijn betaald en hem verzocht vóór het einde van april 2002 cijfermatige gegevens te verschaffen over de besteding van de tussen 1999 en 31 januari 2001 uit hoofde van de secretariaatsvergoeding uitbetaalde gelden, alsmede nadere gegevens over de besteding van de uit hoofde van de vergoeding voor algemene uitgaven uitbetaalde gelden.

It is apparent from the certificate that the Parliament had paid into that account, between 1 July 1999 and 31 December 2001, a total of EUR 495 891.31 by way of travel, general expenditure and secretarial allowances (the secretarial allowance was paid into other accounts from 1 September 2001 onwards).
Uit dit attest blijkt dat het Parlement tussen 1 juli 1999 en 31 december 2001 uit hoofde van de reiskostenvergoeding, de vergoeding voor algemene uitgaven en de secretariaatsvergoeding (de secretariaatsvergoeding werd vanaf 1 september 2001 op andere rekeningen gestort) een bedrag van in totaal 495 891,31 euro op deze rekening had gestort.

The applicant’s parliamentary allowances were paid, from the beginning of his term in 1999 and, as far as the general expenditure and secretarial allowances were concerned, until 31 August 2001, into a current account opened with Banque Bruxelles Lambert SA in his name and that of the EH/B. The latter acted as paying agent within the meaning of Article 14(2) of the Rules Governing the Payment of Expenses and Allowances.
25 De parlementaire vergoedingen van verzoeker zijn sinds het begin van zijn mandaat in 1999 en, wat de vergoeding voor algemene uitgaven en de secretariaatsvergoeding betreft, tot en met 31 augustus 2001 gestort op een rekening-courant op zijn naam en die van de EH/B bij de Banque Bruxelles Lambert SA. De EH/B trad op als derdebetalende in de zin van artikel 14, lid 2, van de Regeling kosten en vergoedingen.

11. Under paragraphs 2 and 7(b) of Article 14 of the Rules Governing the Payment of Expenses and Allowances, Members may appoint a third party, termed a ‘paying agent’, to handle, in whole or in part, the administrative management of his parliamentary assistance allowance (also termed a ‘secretarial allowance’).
11 Overeenkomstig artikel 14, leden 2 en 7, sub b, van de Regeling kosten en vergoedingen kan een lid een derde, „derdebetalende” genoemd, belasten met het volledige of gedeeltelijke administratieve beheer van zijn vergoeding voor parlementaire medewerkers (hierna ook: „secretariaatsvergoeding”).

In this regard the applicant recalls his letter of 6 February 2003 to the Secretary-General (see paragraph 39 above), which contained a new breakdown showing that the justified expenses under the heading of the secretarial allowance now amounted to EUR 191 860, that is to say EUR 138 741 justified by the documents attached to the said letter in addition to the EUR 53 119 already justified by the audit, so that the balance to be repaid to the Parliament amounted to EUR 50 722.
Verzoeker herinnert dienaangaande aan zijn brief van 6 februari 2003 aan de secretaris-generaal (zie punt 39 hierboven), die een nieuwe specificatie bevatte, volgens dewelke de bewezen uitgaven uit hoofde van de secretariaatsvergoeding thans 191 860 euro bedroegen, te weten een bedrag van 138 741 euro dat werd aangetoond door middel van de bij die brief als bijlage gevoegde gegevens, plus een bedrag van 53 119 euro dat reeds door middel van de audit was bewezen, zodat het aan het Parlement terug te betalen saldo 50 722 euro bedroeg.

12. Has decided to enter EUR 17,5 million of the appropriations entered against Items 3910 (Secretarial assistance allowance) in the reserve until the Bureau has clarified the internal rules on the use of the secretarial allowance to take the increased amount into account;

Notes that, according to the European Parliamentary Assistants Association, the Court of Auditors, the Parliament's own Financial Controller and Mr Onesta, the Vice-President responsible for the Statute for Assistants, the new rules on the payment of the secretarial allowance which entered into effect on 1 January 2001 still pose a number of problems, both in terms of ensuring compliance with the Financial Regulation and with relevant national legislation (taxation, social security and so on), and also in terms of user-friendliness; welcomes, therefore, the changes to the rules governing the payment of the secretarial allowance adopted by the Bureau on 9 February 2004; calls on the Secretary-General to ensure that the new rules are strictly enforced; considers, however, that the new requirement that, in the case of service contracts, invoices or fee statements should be accompanied by statements certifying that the staff concerned are duly affiliated to a social security scheme and that tax and social security contributions are duly paid should not be limited to contracts with a duration exceeding six months;
58. merkt op dat volgens de Vereniging van parlementair assistenten van het Europees Parlement, de Rekenkamer, de financieel controleur van het Parlement zelf en de ondervoorzitter die verantwoordelijk is voor het assistentenstatuut, de heer Onesta, de nieuwe regeling inzake de uitbetaling van de secretariaatsvergoeding, die op 1 januari 2001 in werking is getreden, nog steeds een aantal problemen oplevert, zowel wat betreft de naleving van het Financieel Reglement en van de desbetreffende nationale wetgeving (belasting, sociale zekerheid, enz.) als uit een oogpunt van gebruiksvriendelijkheid; betuigt derhalve zijn voldoening over de op 9 februari 2004 door het Bureau goedgekeurde wijzigingen in de regeling inzake de uitbetaling van de secretariaatsvergoeding; verzoekt de secretaris-generaal erop toe te zien dat de nieuwe regeling strikt wordt nageleefd; is evenwel van mening dat de nieuwe eis dat dienstverleningscontracten, facturen of kostendeclaraties vergezeld moeten gaan van een attest dat het betrokken personeel reglementair is aangesloten bij een stelsel van sociale zekerheid en dat de belastingen en socialezekerheidsbijdragen op regelmatige wijze worden betaald, niet beperkt mag blijven tot contracten met een looptijd van meer dan zes maanden;

60. Further considers that, in order to ensure maximum transparency in the use of the secretarial allowance, all assistants paid from the secretarial allowance must be accredited with the Parliament and that, if necessary in order to achieve this, the new category of 'constituency-based accreditation' should be created; notes that as a consequence, the names of all assistants would have to be included in the public register of assistants;
60. is voorts van mening dat met het oog op een maximale transparantie van het gebruik van de secretariaatsvergoeding alle assistenten die met deze vergoeding worden betaald geaccrediteerd moeten zijn bij het Parlement, en dat zonodig een nieuwe categorie "accreditatie op basis van kieskring" moet worden gecreëerd om dit mogelijk te maken; merkt op dat dientengevolge de namen van alle assistenten opgenomen moeten worden in het openbaar assistentenregister;

61. Calls on the Secretary-General to inform the Court of Auditors, within two weeks of adoption of this resolution by the European Parliament in plenary sitting, of those accredited assistants who were not paid either from the secretarial allowance or from any other source given in the declaration of financial interests in 2002; instructs the Court of Auditors, in the cases forwarded by the Secretary-General, to ascertain which funds these assistants were paid from and whether there was any infringement of Parliament's prevailing Rules of Procedure or of national rules;
61. verzoekt de secretaris-generaal de Europese Rekenkamer er binnen twee weken na de plenaire goedkeuring van deze resolutie door het Europees Parlement van in kennis te stellen welke geaccrediteerde assistenten in 2002 noch uit de secretariaatsvergoeding, noch uit enigerlei andere, in de verklaring tot bescherming van de financiële belangen genoemde bronnen zijn gefinancierd; verzoekt de Europese Rekenkamer in de door de secretaris-generaal onderzochte gevallen na te gaan uit welke bronnen deze assistenten zijn betaald en of zich daarbij inbreuken hebben voorgedaan op het Reglement van het Europees Parlement dan wel op de nationale voorschriften terzake;
