1. The negotiations were long and ended in a conciliation process, the main impasses within which were national enforcement bodies and the scope of the regulation. In the end, the regulation is to apply to all regular national or cross-border services, provided that the scheduled distance travelled is equal to or greater than 250 km (‘long distance’).

For a maximum period of 4 years from the date of application of this Regulation, Member States may, on a transparent and non-discriminatory basis, exempt from the application of this Regulation particular regular services because a significant part of such regular services, including at least one scheduled stop, is operated outside the Union.

1. This Regulation shall apply to passengers travelling with regular services for non-specified categories of passengers where the boarding or the alighting point of the passengers is situated in the territory of a Member State and where the scheduled distance of the service is 250 km or more.

Consistent with this right, neither Party shall unilaterally limit the volume of traffic, frequency or regularity of service, or the aircraft type or types operated by the airlines of the other Party, nor shall it require the filing of schedules, programs for charter flights, or operational plans by airlines of the other Party, except as may be required for customs, technical, operational, or environmental (consistent with Article 15) reasons under uniform conditions consistent with Article 15 of the Convention.

In addition, it incorporated a second stage in the directive, whereby the sulphur limit would be tightened up to 0.5% for SOx emission control areas (SECAs) and passenger vessels on regular services from 2011 and for all EU sea areas from 2013 (The main changes to the Commission proposal resulting from the acceptance of Parliament’s first reading amendments are summarised in the schedule at the end of this explanatory statement.)

(21) Member States should determine and publicise the significant wave heights in the sea areas on which ro-ro passenger ships provide regular scheduled ferry services to or from their ports; for international routes the significant wave heights should be established whenever possible in agreement between the States at both ends of the route. Significant wave heights for seasonal operation in the same sea areas may also be determined.

According to Article 4(1)(a) of the Regulation on access for Community air carriers to intra-Community air routes [55], a Member State, following consultations with the other Member States concerned and after having informed the Commission and air carriers operating on the route, may impose a public service obligation in respect of scheduled air services to an airport serving a peripheral or development region in its territory or on a thin route to any regional airport in its territory, any such route being considered vital for the economic development of the region in which the airport is located, to the extent necessary to ensure on that route the adequate provision of scheduled air services satisfying fixed standards of continuity, regularity, capacity and pricing, which standards air carriers would not assume if they were solely considering their commercial interest.
