The COUNCIL: - TAKES NOTE of the request put to it by the Commission, on 27 February 1995, concerning any comments the Council might have on the draft Commission Directive amending Directive 90/388/EEC regarding the abolition of the restrictions on the use of cable television networks for the provision of telecommunications services; - EMPHASIZES that this draft is to be viewed in the light of the Telecommunications Council meeting on 17 November 1994, resulting in the Council Resolution of 22 December 1994 and statements made on that occasion; - NOTES that, when the draft was examined by the Council's subordinate bodies, a series of complex questions, the main subjects of which are listed in the Annex, were put to the Commission by delegations; - NOTES that, after giving some initial answers, the Commission undertook to submit more precise written replies; - TAKES NOTE of the working document presented by the Commission; - TAKES NOTE of the public consultations held by the Commission following publication of its draft Directive in the Official Journal of the European Communities; - INVITES those Member States which so wish to forward their detailed comments as soon as possible to the Commission and to the other Member States, via the General Secretariat of the Council, particularly in the light of the Commission's written replies; - EMPHASIZES that these conclusions are without prejudice to Member States' positions on the form and content of the draft Directive put forward by the Commission; - CALLS UPON the Commission to give the greatest consideration to these positions in following up the procedure initiated.

Publication of the report marks the conclusion of a long procedure involving both the Court of Auditors and the Commission in which: - having completed its inquiries, the Court of Auditors transmits an initial draft report to the Commission; - the Commission produces a detailed written reply to the Court's observations and the points it raised; - adversarial meetings are then held between the two institutions, enabling a large number of issues to be clarified and errors of fact and misinterpretations to be corrected; - the report is finally adopted by the Court and published in the Official Journal.

DRAFT COMMISSION DIRECTIVES ON - MOBILE AND PERSONAL COMMUNICATIONS - IMPLEMENTATION OF FULL COMPETITION IN TELECOMMUNICATIONS MARKETS The Council held a wide-ranging exchange of views on the above draft Directives based on Article 90(3) of the Treaty; it then adopted the following conclusions: "The COUNCIL - NOTES that the Commission requested, on 3 August 1995, any comments from the Council on the draft Commission Directive amending Directive 90/388/EEC as regards mobile and personal communications; sent the President-in-Office of the Council, on 29 September 1995, the draft Commission Directive amending Directive 90/388/EEC as regards the implementation of full competition in telecommunications markets; - NOTES also the public consultation launched by the Commission following the publication of the two draft Directives in the Official Journal of the European Communities; - REAFFIRMS that it is important that the conditions governing the definition of the Community's future policy on the liberalization of telecommunications services and infrastructures should result from a political agreement based on the compromise of December 1989 and takes note of the Commission's support for this approach; - RECALLS in this connection the political agreement reached at the Telecommunications Council meeting on 17 November 1994, which was given concrete form in the Council Resolution of 22 December 1994 and in the statements made on that occasion; RECALLS that this Resolution recognizes in particular the principle of liberalization of telecommunication infrastructures on 1 January 1998, on the understanding that an additional transitional period is granted to certain Member States; - POINTS OUT that the Commission must also take account in its approach of the responsibilities of the European Parliament and the Council for the legislative provisions designed, on the basis of Commission proposals, to establish the European regulatory framework for telecommunications, parti ...
ONTWERP-RICHTLIJNEN VAN DE COMMISSIE MET BETREKKING TOT - MOBIELE COMMUNICATIE EN PERSONAL COMMUNICATIONS - DE VOLLEDIGE OPENSTELLING VOOR DE MEDEDINGING VAN DE MARKTEN VOOR TELECOMMUNICATIEDIENSTEN De Raad hield een uitvoerige gedachtenwisseling over bovengenoemde, op artikel 90, lid 3, van het Verdrag gebaseerde richtlijnen ; vervolgens nam hij de volgende conclusies aan : "DE RAAD, - NEEMT ER NOTA VAN dat de Commissie op 3 augustus 1995 heeft verzocht om eventuele opmerkingen van de Raad over de ontwerp-richtlijn van de Commissie tot wijziging van Richtlijn 90/388/EEG met betrekking tot de mobiele communicatie en personal communications ; de fungerend Voorzitter van de Raad op 29 september 1995 de ontwerp- richtlijn van de Commissie heeft doen toekomen tot wijziging van Richtlijn 90/388/EEG met betrekking tot de volledige openstelling voor de mededinging van de markten voor telecommunicatiediensten ; - NEEMT tevens NOTA van de openbare raadpleging die de Commissie op gang heeft gebracht na de bekendmaking van de twee voornoemde ontwerp- richtlijnen in het Publikatieblad van de Europese Gemeenschappen ; - VERKLAART OPNIEUW dat het van belang is dat de voorwaarden waaronder het toekomstige beleid van de Gemeenschap inzake de liberalisatie van de telecommunicatie-infrastructuur en -diensten wordt bepaald, voortvloeien uit een politiek akkoord dat geënt is op het compromis van december 1989 en neemt er akte van dat de Commissie deze aanpak steunt ; - HERINNERT aan het politieke akkoord dat tijdens de zitting van de Raad Telecommunicatie van 17 november 1994 is bereikt en dat gestalte heeft gekregen in de resolutie van de Raad van 22 december 1994 en in de bij die gelegenheid afgelegde verklaringen ; HERINNERT ERAAN dat in die resolutie met name het beginsel van de liberalisatie van de telecommunicatie- infrastructuur vóór 1 januari 1998 wordt erkend, met dien verstande dat er aan een aantal Lid-Staten een aanvullende overgangsperiode wordt toegekend ; ". - HERI ...
