Posted workers in the context of the provision of services are covered by Directive 96/71/EC[13], which establishes a ‘hard core’ of clearly defined terms and conditions of work and employment for the minimum protection of workers, including minimum rates of pay, which must be complied with by the service provider in the host Member State.

2. The approximation of laws shall extend to the following areas in particular: customs law, company law, laws on banking and other financial services, company accounts and taxes, intellectual property, protection of workers at the workplace, rules on competition, including any related issues and practices affecting trade, public procurement, protection of health and life of humans, animals and plants, the environment, consumer protection, indirect taxation, technical rules and standards, nuclear laws and regulations, transport and electronic communications.
2. The Commission's June 2007 Communication on 'Posting of workers in the framework of the provision of services: maximising its benefits and potential while guaranteeing the protection of workers' (IP/07/817) identified a series of shortcomings in the implementation, application and cross-border enforcement of the Posting of workers Directive.

The notion as recognised in the case law of the Court of Justice covers at least the following grounds: public policy, public security and public health, within the meaning of Articles 46 and 55 of the Treaty; the maintenance of order in society; social policy objectives; the protection of the recipients of services; consumer protection; the protection of workers, including the social protection of workers; animal welfare; the preservation of the financial balance of the social security system; the prevention of fraud; the prevention of unfair competition; the protection of the environment and the urban environment, including town and country planning; the protection of creditors; safeguarding the sound administration of justice; road safety; the protection of intellectual property; cultural policy objectives, including safeguarding the freedom of expression of various elements, in particular social, cultural, religious and philosophical values of society; the need to ensure a high level of education, the maintenance of press diversity and the promotion of the national language; the preservation of national historical and artistic heritage; and veterinary policy.

The Court finds that such a requirement, which is a restriction on the freedom to provide services, is disproportionate in the light of the objective of the social welfare protection of workers who are nationals of non-member States and of the objective of seeking to ensure that the workers return to the Member State of origin at the ending of the posting.

RECALLING the objectives of the Treaty establishing the European Community, particularly the free movement of goods and services, the strengthening of economic and social cohesion, the protection of workers and consumers, the preservation, protection and improvement of the quality of the environment, the competitiveness of industry, and the role standardisation can play to attain these objectives;
