Eligible applicants must be public or private cultural organisations with legal status, whose main activity lies in the cultural sphere, and which are able to demonstrate at least a 2 year long experience in the field of cultural project design and management at international level, in particular in Brazil.

Subsequently, the Court has indicated the following indicators allowing to infer the imputability to the State of a measure taken by a public undertaking: (i) the fact that the undertaking in question could not take the contested decision without taking account of the requirements of the public authorities; (ii) the fact that, apart from factors of an organic nature which linked the public undertakings to the State, a public undertaking, through the intermediary of which aid had been granted, had to take account of directives issued by a central government body, i.e. Comitato Interministeriale per la Programmazione Economica (CIPE); (iii) integration of the public undertaking to the structures of the public administration of the State; (iv) the nature of the undertaking's activities and whether such activities are exercised out on the market in normal conditions of competition with private operators; (v) the legal status of the undertaking (in the sense of its being subject to public law or ordinary company law); (vi) the intensity of the supervision exercised by the public authorities over the management of the undertaking, or (vii) any other indicator showing, in the particular case, an involvement by the public authorities in the adoption of a measure or the unlikelihood of their not being involved, having regard also to the compass of the measure, its content or the conditions which it contains.

Given that social services of general interest (SSGI) make a major contribution to the achievement of the EU's goals, as enshrined in the Treaties, particularly in terms of promoting economic, social and territorial cohesion, calls on the Commission to use the evaluation and revision of the Monti-Kroes package to continue its efforts to clarify and monitor the application of Community rules in the field of SSGI, using a tailored approach which can easily be applied by organising public authorities and takes into account the specific ways in which social services are organised, their legal status and their strongly local nature, as well as the responsibility of the Member States for organising and financing these services;
1. is van mening dat sociale diensten van algemeen belang (SDAB) actief bijdragen aan de verwezenlijking van de in de Verdragen neergelegde doelstellingen van de Unie, inzonderheid wat betreft de bevordering van de economische, sociale en territoriale cohesie, en roept de Commissie er derhalve toe op de evaluatie en herziening van het Monti-Kroespakket te gebruiken om meer duidelijkheid te verschaffen omtrent en toezicht te houden op de toepassing van de EU-regels op het gebied van SDAB door gebruikmaking van een gerichte aanpak die gemakkelijk kan worden toegepast door de organisatie van de overheidsinstanties daarop af te stemmen en acht te slaan op de specifieke organisatorische kenmerken van dergelijke sociale diensten, hun wettelijke status en hun sterk lokale inslag, en door rekening te houden met het feit dat de lidstaten verantwoordelijk zijn voor de organisatie en financiering van deze diensten;

‘research and knowledge dissemination organisation’ or ‘research organisation’ means an entity (such as universities or research institutes, technology transfer agencies, innovation intermediaries, research-oriented physical or virtual collaborative entities), irrespective of its legal status (organised under public or private law) or way of financing, whose primary goal is to independently conduct fundamental research, industrial research or experimental development or to widely disseminate the results of such activities by way of teaching, publication or knowledge transfer.

(7) In particular, a common approach to determine the orphan status and the permitted uses of orphan works is necessary to ensure legal certainty in the internal market with respect to the use of orphan works by libraries, museums, records offices, archives, educational establishments, film heritage institutions, broadcasting organisations and other cultural organisations in the Member States, as well as private collections.

Emphasises that all players, including both public and private interest representatives, outside the EU institutions falling within that definition and regularly influencing the institutions, should be considered lobbyists and treated in the same way: professional lobbyists, companies' in-house lobbyists, NGOs, think-tanks, trade associations, trade unions and employers' organisations, profit-making and non-profit-making organisations and lawyers when their purpose is to influence policy rather than to provide legal assistance and defence in legal proceedings or to give legal advice; stresses also, however, that regions and municipalities of the Member States, as well as political parties at national and European level and those bodies which have legal status under the Treaties, do not fall within the scope of these rules when they are acting in accordance with the role, and carrying out the tasks of such bodies, as provided for in the Treaties;

‘research organisation’ means an entity, such as a university or research institute, irrespective of its legal status (organised under public or private law) or way of financing, whose primary goal is to conduct fundamental research, industrial research or experimental development and to disseminate their its results by way of teaching, publication or technology transfer; all profits must be reinvested in these activities, the dissemination of their results or teaching; undertakings that can exert influence upon such an organisation, for instance in their capacity as shareholders or members of the organisation, shall enjoy no preferential access to the research capacities of such an organisation or to the research results generated by it;
„onderzoeksorganisatie”: een entiteit, zoals een universiteit of onderzoeksorganisatie, ongeacht haar rechtsvorm (publiek- of privaatrechtelijke organisatie) of financieringswijze, die zich in hoofdzaak bezighoudt met het verrichten van fundamenteel onderzoek, industrieel onderzoek of experimentele ontwikkeling en het verspreiden van de resultaten daarvan door middel van onderwijs, publicaties of technologieoverdracht. Takes the view that an active policy of integrating third-country nationals residing legally in the Union should inter alia: set out clear rules governing the legal status of residents and guaranteeing their right to good administrative practice; allow legal integration into the labour market; require third-country nationals to attend courses in the national language(s) organised by the host Member State; entitle them to access to education and ensure that qualifications are recognised; guarantee access to social and healthcare services; endeavour to offer decent living conditions in urban and other localities; ensure that immigrants take part in social, cultural and political life;
