SACE annexed thereto various supporting documents, including a resubmission of the business plan for 2005-2008 for the operation of the short-term insurance prepared by SACE with the help of an external advisor, KPMG, and approved by the Board on 18 May 2004 (‘the initial business plan’), a letter from an external advisor of 7 July 2004, specifying the additional services provided (‘the advisor letter’), supplementary analyses to the business plan regarding the Italian market of the commercial information, the Italian market of the recovery of credits and its principal actors and the credit insurance market in the Central and Eastern Europe of March 2004 (‘the supplements to the business plan’), the adjustment of the Business Plan 2005-2009 approved on 19 November 2004 (‘the adjusted business plan’), extracts of the minutes of the Board of 28 April 2004, 18 May 2004, a business plan regarding potential acquisition of Assicuratrice Edile S.p.A. of May 2005 (‘Assedile acquisition business plan’), revised budget for SACE BT of 31 March 2009, SACE BT business plan for 2010-2011 of 4 August 2009 (‘the 2010-2011 business plan’).

4. Where the implementation of an alert mechanism entails revision of performance plans and targets, the Commission shall facilitate such revision through an appropriate adjustment of the applicable time schedule in accordance with the procedure referred to in Chapters II and III.

Where the SMP operator envisages to replace part of its existing copper access network with fibre and plans to de-commission currently used points of interconnection, NRAs should obtain the relevant information from the SMP operator, and should under Article 9(1) of Directive 2002/19/EC ensure that undertakings enjoying access to the SMP operator’s network receive all necessary information in timely fashion to adjust their own networks and network extension plans accordingly.

4. Where the implementation of an alert mechanism entails revision of performance plans and targets, the Commission shall facilitate such revision through an appropriate adjustment of the time schedule applicable in accordance with the procedure referred to in Chapters II and III of this Regulation.
4. Wanneer de tenuitvoerlegging van een waarschuwingsmechanisme resulteert in de herziening van prestatieplannen en -doelen, ondersteunt de Commissie een dergelijke herziening via een gepaste bijstelling van het tijdschema dat van toepassing is overeenkomstig de in de hoofdstukken II en III van deze verordening vastgestelde procedure.

Consistent with this right, neither Party shall unilaterally limit the volume of traffic, frequency or regularity of service, or the aircraft type or types operated by the airlines of the other Party, nor shall it require the filing of schedules, programs for charter flights, or operational plans by airlines of the other Party, except as may be required for customs, technical, operational, or environmental (consistent with Article 15) reasons under uniform conditions consistent with Article 15 of the Convention.

11. Validity of the invitation to tender: This invitation to tender shall be valid provided that, by 1.3.2006, no Community air carrier has declared (by submitting a flight plan to the Civil Aviation Authority) its intention of operating scheduled flights on one or more of the above-mentioned routes from 1.4.2004, in accordance with the public service obligation imposed and without receiving financial compensation.
11. Geldigheid van de aanbesteding: Deze aanbesteding is slechts geldig wanneer geen enkele communautaire luchtvaartmaatschappij vóór 1.3.2006 bij de Burgerluchtvaartautoriteit een programma heeft ingediend om deze verbinding met ingang van 1.4.2006 te exploiteren in overeenstemming met de opgelegde verplichtingen van openbare dienstverlening, zonder daarvoor een financiële compensatie te ontvangen.
