Core texts which must be applied for migrants as well as nationals include the Universal Declaration of Human Rights, the International Covenants on Civil and Political Rights and on Economic, Social and Cultural Rights, the 1951 Geneva Convention Relating to the Status of Refugees and the 1967 Protocol to that Convention, the 1954 Convention relating to the Status of Stateless Persons, the 1961 UN Convention on the Reduction of Statelessness, Convention on Rights of the Child, the two UN Palermo Protocols on Smuggling of Migrants and Trafficking in Persons, the International Convention on the Elimination of All Forms of Racial Discrimination, the UN Convention against Torture, and the ILO Convention on decent work for domestic workers.

The proposal is underpinned by numerous legal instruments including the UN Convention on the Law of the Sea, the International Convention on Maritime Search and Rescue, the International Convention for the Safety of Life at Sea and the Protocol against the Smuggling of Migrants by Land, Sea and Air, supplementing the United Nations Convention against Transnational Organised Crime, known as the Palermo Convention.

In a broader context the UN Convention against Transnational Organised Crime in Palermo on December 12 - 15 2000 and its two accompanying protocols on trafficking in persons and smuggling of migrants [11] now form the basis for a global recognition of the problem and a comparable approach to tackle it.
