TRADUCTIONS EN CONTEXTE

As the main purpose of this Regulation is to introduce a number of legal obligations imposed directly on market operators consisting, inter alia, of the recording in book-entry form in CSDs of all transferable securities once such securities are traded on trading venues regulated by Directive 2014/65/EU and Regulation (EU) No 600/2014 or provided as collateral under the conditions of Directive 2002/47/EC and in the settling of their obligations no later than on the second business day after trading takes place and as CSDs are responsible for the operation of securities settlement systems and the application of measures to provide timely settlement in the Union, it is essential to ensure that all CSDs are safe and sound and comply at all times with stringent organisational, conduct of business and prudential requirements laid down in this Regulation, including by taking all reasonable steps to mitigate fraud and negligence.

1. The competent authority of the CSD that operates the securities settlement system, the relevant authority responsible for the oversight of the securities settlement system concerned as well as the competent authorities for the supervision of trading venues, investment firms and CCPs shall be competent for ensuring that Articles 6 and 7 are applied by the institutions subject to their supervision and for monitoring the penalties imposed.

‘central securities depository’ or ‘CSD’ means a legal person that operates a securities settlement system referred to in point (3) of Section A of the Annex and provides at least one other core service listed in Section A of the Annex.

11. Considers the issue of financing for CSDP missions and operations to be crucial if the policy is to have a future; finds it regrettable that specific proposals have not yet emerged from the discussion initiated on this subject at the December 2013 Council meeting; calls for the Athena mechanism to be used systematically for the financing of the CSDP’s operational and mission deployment costs, in particular as regards the use of EU battlegroups, accommodation infrastructure for forces, expenses relating to the establishment of points of entry for troops into theatres of operations and security stocks of food and fuel where necessary; calls, also, for the same mechanism to be used to manage financing received from Member States on a bilateral basis, and from third countries and international organisations, so that they can participate in the financing of a given operation and, in duly justified cases, support the participation by third countries in EU crisis response operations and missions;
11. is van mening dat het vraagstuk rond de financiering van de GVDB-missies en -operaties van wezenlijk belang is voor de toekomst van dit beleid; betreurt dat het tijdens de vergadering van de Raad in december 2013 begonnen debat hierover vooralsnog tot geen enkel concreet voorstel geleid heeft; acht het wenselijk dat het Athenamechanisme systematisch de uitgaven van GVDB-missies en -operaties dekt, in het bijzonder in verband met de inzet van EU-gevechtstroepen, infrastructuur voor de huisvesting van de troepen, uitgaven met betrekking tot de instelling van toegangspunten voor troepen tot het strijdtoneel en, indien nodig, veiligheidsvoorraden van voedsel en brandstof; acht het bovendien wenselijk dat dit mechanisme wordt gebruikt voor het beheer van de financiering door lidstaten, op bilaterale wijze, en door derde landen en internationale organisaties, waardoor deze in staat worden gesteld om financieel aan operaties deel te nemen en dat in bijzonder gegronde gevallen de deelname van derde landen in crisisinterventieoperaties en -missies van de Europese Unie wordt ondersteund;

23. Deplores, in this context, that the review of the Athena mechanism, which was due to be carried out by the end of 2014, has produced only very limited results, such as the organisation of a form of pre-financing of certain costs to speed up deployment; regrets that the Council did not reach an agreement on the inclusion of funding for the cost of the strategic deployment of EU battlegroups in the list of common costs systematically borne by Athena, only adopting instead a renewable decision for a two-year period; calls on the next European Council on Defence to consider a further expansion of the common costs eligible under Athena, such as the automatic financing of expenditure on CSDP operational and mission deployment (infrastructure for the accommodation of forces, expenses relating to the establishment of points of entry for troops into theatres of operations and security stocks of food and fuel where necessary);

When a Central Securities Depository (CSD), as defined in point (1) of Article 2(1) of Regulation (EU) No 909/2014 of the European Parliament and of the Council , or a third-country CSD provides the services of operating a securities settlement system as well as at least either the initial recording of securities in a book-entry system through initial crediting or providing and maintaining securities accounts at the top tier level, as specified in Section A of the Annex to that Regulation, the provision of those services by that CSD with respect to the securities of the UCITS that are initially recorded in a book-entry system through initial crediting by that CSD should not be considered to be a delegation of custody functions.

(19) As the main purpose of this Regulation is to introduce a number of legal obligations imposed directly on market operators consisting, inter alia, in the recording in book-entry form in a CSD of all transferable securities once such securities are traded on trading venues regulated by Directive [new MiFID] or provided as collateral under the conditions of Directive 2002/47/EC and in the settling their obligations no later than on the second business day after trading takes place and as CSDs are responsible for the operation of securities settlement systems and the application of measures to provide timely settlement in the Union, it is essential to ensure that all CSDs are safe and sound and comply at all times with stringent organisational, conduct of business, including by taking all reasonable steps to mitigate against fraud and negligence, and prudential requirements established by this Regulation.

To that effect, transmission system operators shall maintain an appropriate level of technical transmission reserve capacity for operational network security and cooperate with the transmission system operators concerned to which they are interconnected.
