It is clear from the judgment under appeal that, by letter of 15 October 2010, the acting Director-General of OLAF informed the applicant, in response to her application for the extension of her temporary contract, that that contract would end on 31 December 2010, bearing in mind that there was no possibility of extension beyond the maximum period of eight years for temporary staff employed within OLAF.
Vastgesteld zij dat uit het bestreden arrest blijkt dat de waarnemend directeur-generaal van OLAF rekwirante bij brief van 15 oktober 2010, in antwoord op haar verzoek om verlenging van haar overeenkomst van tijdelijk functionaris, heeft aangegeven dat deze overeenkomst op 31 december 2010 zou aflopen, daar er geen mogelijkheid was om deze nog te verlengen na de maximumperiode van acht jaar voor tijdelijk personeel bij OLAF.

Finds particularly distressing the fact that sending files or complaints to OLAF has become the standard procedure to excuse the general "no-action-and-no-information" attitude; in this context, it is essential that clear channels of communication between OLAF and the institutions in which alleged wrongdoing takes place be established; the institutions concerned must take preventive action wherever necessary to protect the Community's financial interests unless a request has been made by OLAF or national judicial authorities for the European institutions to refrain from taking such action in order to avoid compromising ongoing investigations: is of the opinion that a review of the OLAF Regulation is therefore required; urges OLAF also to arrange for close consultation with those who provide OLAF with evidence of irregularities or fraud; considers that, after an acknowledgement of receipt, such 'whistle-blowers' must be informed at fixed intervals of the progress of the investigation, and that at all events whistle-blowers must not be left in the dark as to the use being made of their information; urges that extra staff with accountancy expertise also be recruited to OLAF, in such a way as to attain a good mix of chartered accountants, forensic accountants and EDP auditors;

as regards relations with OLAF: regrets the fact that the Commission has not yet submitted an assessment of the current OLAF system to complement the proposal under consideration; considers that OLAF currently lies at the heart of the system to combat Community fraud but that it must be improved in such a way as to embody the legal guarantees which it requires if it is to acquire the legitimacy which it lacks; considers that OLAF should assist the European Public Prosecutor both in the forwarding of information and in the carrying out of investigations; considers, therefore, that it is quite acceptable o enlarge OLAF's remit to include powers of criminal investigation (accompanied by the necessary provisions relating to protection of the individual) and to make OLAF an entirely independent body; awaits the Commission's proposals on this point; considers that the substantial shortcomings in terms of OLAF's legal status must be remedied and that this applies both to its legal basis and to judicial control of OLAF's activities;
wat de verhoudingen met het OLAF betreft: betreurt het dat de Commissie nog geen evaluatie heeft opgesteld van de huidige structuur van het OLAF als aanvulling op het onderhavige voorstel; meent dat het OLAF op dit moment de spil vormt van het gemeenschappelijke systeem voor fraudebestrijding, maar zodanige verbetering behoeft dat het de nodige rechterlijke waarborgen bevat voor een legitimiteit die het thans ontbeert; is van mening dat het OLAF de openbare aanklager moet bijstaan zowel bij het doorgeven van gegevens als bij onderzoek en opsporing; acht het daarom zeer wel denkbaar dat het werkterrein van het OLAF met strafrechtelijke opsporingsbevoegdheden wordt uitgebreid, hetgeen gepaard moet gaan met de nodige regelingen ter bescherming van de individuele burger, en het OLAF tot geheel onafhankelijk orgaan wordt verheven; ziet de voorstellen van de Commissie hieromtrent met belangstelling tegemoet; de aanzienlijke tekortkomingen van het OLAF op het gebied van de rechtsstaat moeten worden opgeheven, hetgeen zowel voor de rechtsgrondslag alsook voor de toetsing door de rechter van de werkzaamheden van het OLAF geldt;
