The United Kingdom notified the Commission of its intention to introduce a tax relief in Northern Ireland, applied to virgin aggregate extracted in Northern Ireland and commercially exploited there and processed products from virgin aggregate extracted in Northern Ireland commercially exploited there from a levy on aggregates set-up in the United Kingdom (‘the measure’) by letter of 5 January 2004, registered on 9 January 2004.

1. To remove the discrimination suffered by companies that imported aggregates into Northern Ireland paying the full Aggregates Levy without the possibility of benefiting from the modified relief from that levy applied in Northern Ireland, the United Kingdom authorities shall implement a mechanism to retroactively reimburse 80 % of the full levy collected from importers of aggregates into Northern Ireland between 1 April 2004 and 30 November 2010.

This decision concerns exclusively the modified AGL relief in Northern Ireland, which was applied to virgin aggregate extracted in Northern Ireland and commercially exploited there and processed products from virgin aggregate extracted in Northern Ireland commercially exploited there.

The Commission, after examination of the request from the United Kingdom for the region of Northern Ireland, having considered the Action Programme and in the light of the experience gained from the derogation provided for in Decision 2007/863/EC as amended by Decision 2011/128/EU considers that the amount of livestock manure proposed by Northern Ireland, corresponding to 250 kg nitrogen per hectare per year, will not prejudice the achievement of the objectives of Directive 91/676/EEC, subject to certain strict conditions being met.

Regards the Northern Dimension as a focal point for regional cooperation in Northern Europe; notes that the four partners, namely the EU, Iceland, Norway and the Russian Federation, as well as the Arctic Council, the Barents Euro-Arctic Council, the Council of the Baltic Sea States, the Nordic Council of Ministers, the European Bank for Reconstruction and Development (EBRD), the European Investment Bank (EIB), the Nordic Investment Bank (NIB) and the World Bank (IBRD), are participants in the Northern Dimension and that both Canada and the United States hold observer status in the Northern Dimension; stresses the need for close alignment between the Northern Dimension policy and the EU's evolving Arctic policy; notes the Northern Dimension's Arctic Window; highlights the valuable experience of the Northern Dimension partnerships, particularly the new Northern Dimension Partnership on Transport and Logistics and its benefits for cooperation in the Arctic;

Stresses that the successful accession of 10 new countries, including those involved in the Northern Dimension, has taken the Northern Dimension into a new phase; calls on the Commission to allocate adequate resources to the Northern Dimension policy in order to allow new future partnerships to be envisaged, inter alia in the fields of transport, logistics, energy and culture; considers that the partnership in social and health affairs should be more adequately supported; consequently, calls on the Commission, as part of its current work on the future of the Northern Dimension, to seriously consider whether a separate budget line for the Northern Dimension would help to raise its profile, while being in line with the Northern Dimension's character as a framework policy for the northern region; notes that such a proposal must take account, and increase the transparency, of the various sources of financing, including co-financing from third parties; underlines the need to take into account the special needs of the northern regions in the work of all Directorates-General and in all parts of the EU budget;

This provision applies to England and Wales and to Scotland, and to any Westminster legislation that applies to Northern Ireland (Similar provision is made for Northern Ireland legislation by section 37 of the Interpretation (Northern Ireland) Act 1954).
