According to the Presidency conclusions of the European Council in Tampere of 15 and 16 October 1999, and in particular point (33) thereof, enhanced mutual recognition of judgments and other judicial decisions and the necessary approximation of legislation would facilitate cooperation between competent authorities and the judicial protection of individual rights. The principle of mutual recognition should therefore become the cornerstone of judicial cooperation in civil and criminal matters within the Union.

2. The contact points shall provide the local judicial authorities in their own Member State, the contact points in the other Member States and the local judicial authorities in the other Member States with the legal and practical information necessary to enable them to prepare an effective request for judicial cooperation or to improve judicial cooperation in general.

The European Judicial Network shall be made up, taking into account the constitutional rules, legal traditions and internal structure of each Member State, of the central authorities responsible for international judicial cooperation and the judicial or other competent authorities with specific responsibilities within the context of international cooperation.

28. Regrets that, under Article 10 of the Protocol on transitional provisions annexed to the Treaty of Lisbon, the powers of the Court of Justice with respect to acts in the field of police cooperation and judicial cooperation in criminal matters adopted before the entry into force of that Treaty are to remain the same as they are under the present EU Treaty for a transitional period of five years; welcomes, however, the declaration made by the Intergovernmental Conference concerning that article of the Protocol and accordingly urges the Council and the Commission to join with Parliament in re-adopting those acts in the field of police cooperation and judicial cooperation in criminal matters which were adopted before the entry into force of the Treaty of Lisbon;

In view of these exceptional circumstances, I am forwarding to you the substance of the Commission's position on the initiative on police and judicial cooperation to combat terrorism (see Annex I), and that of the Commission's services on the initiative for a mechanism for evaluating the legal systems and their implementation at national level in the fight against terrorism (see Annex II).
Gelet op de uitzonderlijke omstandigheden deel ik U hierbij gaarne de essentie mede van het standpunt van de Commissie omtrent het initiatief voor de politiële en justitiële samenwerking ter bestrijding van het terrorisme (bijlage I) en omtrent het initiatief voor een regeling ter evaluatie van de nationale rechtsregels inzake de bestrijding van het terrorisme en de toepassing daarvan (bijlage II).

In order to meet its responsibilities under Article 3 concerning international instruments on judicial cooperation in civil and commercial matters, the Network shall maintain contact and exchanges of experience with the other judicial cooperation networks established between third countries and with international organisations that promote international judicial cooperation.

Stresses that, in cases of judicial cooperation between Ministries of Justice, the diplomatic channel should no longer be obligatory, and that, in cases of direct judicial cooperation between the judicial authorities, the latter should have effective structures for technical and operational assistance at their disposal in order to ensure, in both cases, the swiftest cooperation;

8. Stresses that judicial cooperation activities must be conducted with due regard for the constitutional principles of the Member States and the provisions of the European Convention on Human Rights; expresses its concern that, as far as judicial cooperation in criminal matters is concerned, the Treaty of Amsterdam does not lay down as mandatory the jurisdiction of the Court of Justice to make preliminary rulings, but actually rules it out automatically until such time as a Member State expressly recognizes it individually and draws up the relevant rules; sees therein a danger that the advances provided by the Treaty of Amsterdam in relation to the judicially enforceable protection of human rights, could be called into question;
