In the present situation, the Article 29 Working Party took the view in its opinion 6/2002 of 24 October 2002 that consent should not be relied on and that the exception to the "adequate protection" requirement provided for in Article 26 (1) (a) of the Directive ("the data subject has given his consent unambiguously to the proposed transfer") did not therefore provide a sound legal solution.
In de huidige situatie was de Groep artikel 29 in haar advies 6/2002 van 24 oktober 2002 van oordeel dat op toestemming niet kon worden vertrouwd en dat de uitzondering op de eis tot "passende bescherming" in artikel 26, lid 1, onder a), van de richtlijn ("de betrokkene heeft voor de voorgestelde doorgifte zijn ondubbelzinnige toestemming gegeven") dus geen juiste juridische oplossing bood.

Therefore once the Hague Convention had been concluded, its provisions were taken into account by the Working Party, particularly those directly affecting the Convention now under consideration, i. e. Article 10 regarding the jurisdiction of the courts deciding on the annulment of a marriage, an application for divorce or legal separation of the parents to take measures directed to the protection of the child and Article 52 regarding the relationship between the Hague Convention and other Conventions, and particularly the possibility for one or more Contracting States to conclude agreements which contain, in respect of children habitually resident in any of the States Parties to such agreements, provisions on matters governed by the Hague Convention.
