Article 6 of Annex III to the Staff Regulations, Section D.4 of the notice of competition and Section III. 3 of the Guide for Applicants constitute, precisely, special provisions which derogate from those of Regulation No 1049/2001, since they govern access to specific types of documents, namely the candidates’ papers for the written tests and the evaluation sheets drawn up by the selection board for those tests.
Artikel 6 van bijlage III bij het Statuut, titel D, punt 4, van de aankondiging van vergelijkend onderzoek en titel III, punt 3, van de Gids voor de kandidaten vormen nu juist bijzondere bepalingen die afwijken van die van verordening nr. 1049/2001, aangezien zij de toegang tot een specifiek soort documenten regelen, namelijk de schriftelijke examens die door de kandidaten zijn afgelegd en de beoordelingsformulieren van die examens door de jury.

Secondly, having taken part in the competition as a candidate, any request for information concerning her participation in that competition made to EPSO is governed by Annex III to the Staff Regulations, Section D.4 of the notice of competition and Section III. 3 of the Guide for Applicants.
Anderzijds wordt, daar verzoekster als kandidaat heeft deelgenomen aan het vergelijkend onderzoek, elk bij EPSO ingediend verzoek om informatie over die deelneming geregeld door bijlage III bij het Statuut, titel D, punt 4, van de aankondiging van vergelijkend onderzoek en titel III, punt 3, van de Gids voor de kandidaten.

In the present case, it should be noted, first, that, as the ground for the refusal to send the applicant her marked written tests (b) and (c), the e-mail of 14 September 2009 refers to Article 6 of Annex III to the Staff Regulations, which provides that the proceedings of the selection board are to be secret; secondly, that, as is apparent from the case-law cited in the preceding paragraph, since the communication of marks obtained in the tests constitutes an adequate statement of the reasons, the board is not required to identify which of the candidates’ answers were considered unsatisfactory; lastly, Section III. 3 of the Guide for Applicants, a document which was available to the applicant, makes no provision for candidates to be sent their marked written tests.
In casu moet om te beginnen worden vastgesteld dat de e-mail van 14 september 2009 ter motivering van de weigering om verzoekster haar gecorrigeerde schriftelijke examens b) en c) toe te zenden verwijst naar artikel 6 van bijlage III bij het Statuut, dat bepaalt dat de werkzaamheden van de jury geheim zijn. Voorts vormt de toezending van de voor de examens behaalde punten, zoals uit de in het voorgaande punt aangehaalde rechtspraak blijkt, een toereikende motivering, daar de jury niet gehouden is om de ontoereikend geachte antwoorden van de kandidaten te preciseren. Ten slotte wordt in titel III, punt 3, van de Gids voor de kandidaten, waarover verzoekster beschikte, niet bepaald dat de gecorrigeerde schriftelijke examens aan de kandidaten worden toegezonden.

It follows that, since Regulation No 1049/2001 is not applicable in the present case and Article 6 of Annex III to the Staff Regulations, Section D.4 of the notice of competition and Section III. 3 of the Guide for Applicants do not require EPSO to send candidates their marked written tests, the first plea must be rejected as being in part inadmissible and in part unfounded.
Hieruit volgt dat aangezien verordening nr. 1049/2001 in casu niet van toepassing is en artikel 6 van bijlage III bij het Statuut, titel D, punt 4, van de aankondiging van vergelijkend onderzoek en titel III, punt 3, van de Gids voor de kandidaten EPSO niet verplichten om de kandidaten hun gecorrigeerde schriftelijke examens toe te zenden, het eerste middel deels niet-ontvankelijk en deels ongegrond moet worden verklaard.

13. Notes that the Authority has had a Practical Procurement Guide since 2008 to provide practical guidance to its staff in preparing and implementing procurement procedures and the resulting contracts, and that the Guide is regularly updated; notes moreover that the Guide is being revised to take into account the rules recently adopted by the Commission on public procurement and revision of the Financial Regulation;
13. merkt op dat de Autoriteit sinds 2008 beschikt over een praktisch aanbestedingshandboek, met praktische aanwijzingen voor het personeel bij het voorbereiden en uitvoeren van aanbestedingsprocedures en de contracten die daaruit voortvloeien, en dat dit handboek regelmatig wordt bijgewerkt; merkt bovendien op dat dit handboek wordt herzien om rekening te houden met de onlangs door de Commissie aangenomen aanbestedingsregels en de herziening van het Financieel Reglement;

14. Acknowledges that the level of implementation of the College's recruitment guide bringing the procedures in line with the Staff Regulations of Officials of the European Union was considered to be sufficient by the College; calls also on the Court of Auditors to assure Parliament on the level of implementation of this guide;
17. stelt vast dat de mate waarin de wervingshandleiding van de Academie, waarmee de procedures op één lijn zijn gebracht met het Ambtenarenstatuut van de Europese Unie , ten uitvoer is gelegd door de Academie als voldoende wordt beoordeeld; verzoekt de Rekenkamer om het Parlement zekerheid te verschaffen omtrent de mate waarin de handleiding ten uitvoer is gelegd;
