‘1a. By way of derogation from Article 34(1) of Regulation (EU) No 1308/2013, the Union financial assistance for withdrawal operations referred to in Article 1(2)(a) of this Regulation for destinations other than free distribution shall be 75 % of the maximum amounts of the support for other destinations referred to in Annex XI to Implementing Regulation (EU) No 543/2011’.

The proposal for a directive seeks to approximate national provisions relating to the advertising of tobacco products and their promotion (a) in the press and other printed publications; (b) in radio broadcasting; (c) in information society services; and (d) through tobacco related sponsorship, including the free distribution of tobacco products so as to ensure the free movement of the media concerned and related services and to eliminate obstacles to the operation of the internal market (Article 1).

2. However, notwithstanding paragraph 1, it may be decided that intervention agencies are to make unprocessed sugar held by them available, for human consumption on the internal market of the Community, to charitable organisations - recognised by the Member State concerned or by the Commission in cases where a Member State has not recognised any such organisations - at a price which is lower than the intervention price, or free of charge, for free distribution as part of individual emergency aid operations.

In afwijking van lid 1 kan worden besloten dat de interventiebureaus onverwerkte suiker die zij in hun bezit hebben, ter beschikking stellen van door de betrokken lidstaat erkende liefdadigheidsorganisaties of, indien in deze lidstaat geen organisaties zijn erkend, dergelijke door de Commissie erkende organisaties, voor gratis verdeling in het kader van gerichte spoedacties, tegen een lagere prijs dan de interventieprijs of gratis, voor menselijke consumptie op de interne markt van de Gemeenschap.

The provisions of Regulation (EEC) No 2103/90, of Article 2 of Regulation (EEC) No 3587/86 and of Regulation (EEC) No 2276/92 shall apply, within the territory of the Member States, to the free distribution operations referred to in Article 1.
Voor de in artikel 1 bedoelde gratis uitreiking gelden de bepalingen van de Verordeningen (EEG) nr. 2103/90 en (EEG) nr. 2276/92 alsmede die van artikel 2 van Verordening (EEG) nr. 3587/86, voor zover het handelingen binnen het grondgebied van de Lid-Staten betreft.
