– (PT) I voted in favour of this report as I believe that the European financial market cannot survive or function adequately if the financial supervision mechanisms for the EU area continue to differ within the EU. I think that it is essential for the EU to develop a new financial architecture that includes robust financial supervision that operates in the same way across the various countries of Europe.

The report sets out a list of transparency rules that apply today to the different players in the financial markets in the EU. To my mind, what is important is that the market is provided with a sufficient degree of clear information that is useful.

The Council then further considered inter alia that "the development of Level 3, including enhancing supervisory co-operation and convergence of supervisory practices, and full and consistent implementation as well as enforcement of adopted legislative measures are crucial for the delivery of the benefits of the Lamfalussy framework to market participants"; Its conclusions of 7 December 2004, whereby it welcomed "the establishment of the Committee of European Banking Supervisors (CEBS) and the Committee of European Insurance and Occupational Pensions Supervisors (CEIOPS) ", noted "that the new committees are already contributing to regulatory preparations, supervisory co-operation, convergence of supervisory practices, and the assessment of financial stability" and further recalled that "all elements of the Lamfalussy framework shall be monitored regularly to ensure the new structure to be rapidly implemented"; Its conclusions of 5 May 2006 on the Commission White Paper on the financial services policy (2005-2010), whereby it emphasised "the need to pay particular attention to supervisory convergence as underlined in the FSC Report on Financial Supervision and to optimising the cooperation between home/host supervisors within the current legal framework" and that "the Lamfalussy approach is an important element in the overall regulatory stance developed to face the challenge of accelerating financial market integration.

RECALLS the conclusions of the European Council of 23-24 March 2006, in particular where the Council noted that "Preparing for ageing populations and the ambition to reap the full benefits of globalisation will be the two main drivers for structural reforms" and that "Further comprehensive reforms are needed in many Member States to improve the sustainability of their welfare systems, and meet the economic and budgetary consequences of ageing"; RECALLS the Council (ECOFIN) conclusions of 5 May 2006, whereby it stressed "the need to boost the efficiency of pan-European markets for long-term savings products as well as the importance of fostering financial education and awareness of consumers in Member States" and invited the FSC to "examine the policy issues related to ageing and financial markets"; ENDORSES the Report on the implications of ageing for financial markets, elaborated by the FSC according to that mandate, and STRESSES in particular the following points for further monitoring and action by Member States, which are invited i.a. to: Develop or strengthen adequate statistical tools to better monitor the composition of households' portfolios and changes in households' risk profiles; Significantly step up their efforts to raise households' awareness on the latter's need to obtain proper information and education, in combination with the financial industry's own responsibilities and initiatives as appropriate, so as to increase households' preparation whilst maintaining adequate investor protection; Consider, where appropriate, possible additional solutions so as to increase the participation and contribution levels of households in non-statutory pension schemes and address relevant cases of possible insufficient access to pension products and schemes, e.g. for low-income households, drawing experience from other national experiences as appropriate; Encourage industry's efforts to further enhance the supply of pension savings products, where relevant, and ...

Building on the Commission's White Paper on Financial Services, the results of the Commission's sector inquiry into retail banking and the interim report on business insurance, the Green Paper on Retail Financial Services sets out the overarching objectives of the Commission’s policy in the area of retail financial services, presents in more detail the actions necessary to bring the benefits of integrated EU financial market to users, and requests feedback from stakeholders on the direction being taken.

Welcomes the rapid modernisation of the Chinese financial sector; stresses, however, the utmost importance of ensuring a smooth transition to avoid any financial instability with possible repercussions across global financial markets; suggests, in particular, that a 'race to the bottom' involving harmful regulatory competition between global financial marketplaces, should be avoided; suggests, on the contrary, that major regulators worldwide should promote standards of the highest quality; recalls that the EU itself is committed to the global convergence of standards in the areas of accounting (International Financial Reporting Standards), audit (International Standards on Auditing), capital requirements for credit institutions (Basel II), money laundering and the fight against financing terrorism (Financial Action Task Force on Money Laundering (FATF) recommendations) and securities market regulation (International Organization of Securities Commissions standards); points out that the EU would be ready to offer its experience and assistance to the Chinese authorities to implement convergence where necessary;

The report before you sets out a useful strategy for creating lead supervisory practices in the EU. With a longer term perspective, provided that the parliamentary accountability of any new body thus created is guaranteed, we can see the benefits of moving towards a more uniform supervisory regime for financial markets.
Het verslag dat voorligt, schetst een nuttige strategie voor de totstandbrenging van "lead supervisor"-praktijken in de EU. 1. Supports the main guidelines set out in the Commission communication, which was drawn up in response to the report by Mr Jaap Winter. Deplores, however, the narrow focus on almost exclusively the shareholders-management relationship, is not convinced of the assumption that shareholders are the best and only watchdog against the failures and scandals in recent history, and regrets the underestimation of and lack of attention to the role of company management (executive and non-executive) to safeguard the balance between the interests of different stakeholders and the wider public interest in a broader context of corporate social responsibility. A European initiative is vital to strengthen or restore public confidence in European financial markets. The aim is to make existing rules on company law more flexible and, in particular, facilitate cross-border restructuring in Europe. Integration of the financial markets brings with it a need to reform corporate governance. A measure of this kind must promote convergence of these rules and prevent excessive legal competition between Member States of the Union.

The Council also adopted the following conclusions on SME access to financial markets: "COUNCIL CONCLUSIONS ON THE FEASIBILITY OF CREATING A EUROPEAN CAPITAL MARKET FOR SMALL AND MEDIUM-SIZED ENTERPRISES In the light of the debate held on the basis of the Commission's communication on the creation of a European capital market for smaller entrepreneurially managed growth companies and given the opportunity to promote the setting up of innovative projects in any area of activity, strengthening these enterprises' capital structures, in order to facilitate the development of European SMEs and create new jobs in the Union, THE COUNCIL: - welcomes the European Commission's initiative to promote the debate on the creation of new Europe-wide capital markets; - invites the Commission to go deeper into the conclusions of its communication and report to the next Industry Council on ways to overcome the various obstacles currently existing in the Member States, including obstacles inhibiting the channelling of funds of institutional and private investors, in order to support the creation of secondary European Capital Markets for SMEs, taking into account the national systems and experiences already under way; - submits to the Commission's consideration the advisability of encouraging investors to join the European secondary capital market in order to mobilise additional financial resources for European SMEs; - urges the Commission to cooperate with Member States in order to overcome the difficulties that exist in making cross-border security transactions, by facilitating progress towards the future operation of a pan-European secondary capital Market, such as EASDAQ (European Association of Security Dealers Automated Quotation).
