Should the court, in the context of its examination as to jurisdiction in accordance with Articles 25 and 26 of Regulation (EC) No 44/2001, conduct a comprehensive taking of evidence in relation to disputed facts which are of relevance both for the question of jurisdiction and for the existence of the claim (‘doubly relevant facts’) or should it, when determining jurisdiction, start from the premise that the facts asserted by the applicant are correct?

The truth is that this proposal does not help prevent any conflicts of jurisdiction, and does not provide for any settlement when such situations arise. This could be done, for example, by reducing multiple jurisdiction and by allocating jurisdiction to Member States, as was done through various regulations on civil law, with the obligation to mutually recognise the decisions that followed from that allocation of jurisdiction.

Recommends that it should be examined whether the legal nature of the timesharing contract can be defined as a consumer contract under Community law, so that the general rules of Community law for the protection of consumers apply and to prevent forum shopping, either by reference to the general place of jurisdiction for consumer law or the right of jurisdiction of the place in which the property is situated, calls on the Commission in this context to examine to what extent alternative conciliation mechanisms, such as those proposed by the Commission in its communication on widening consumer access to alternative dispute resolution (COM(2001) 161 final), can be established in order to assist the consumer in asserting his rights under this Directive;

Conventions dealing with such matters are normally confined to the recognition and enforcement of judgments and the concomitant inclusion of rules on indirect jurisdiction, that is to say the examination of the jurisdiction of the court of origin to be made by the court of the State in which recognition is sought.
