(5) The Convention on the Grant of European Patents (European Patent Convention), as amended (hereinafter "EPC"), established the European Patent Organisation and entrusted it with the task of granting European patents.

This Regulation constitutes a special agreement within the meaning of Article 142 of the Convention on the Grant of European Patents (European Patent Convention), as amended (hereinafter "the EPC").
Deze verordening maakt een bijzondere overeenkomst uit in de zin van artikel 142 van het Verdrag inzake de verlening van Europese octrooien (Europees Octrooiverdrag), zoals gewijzigd (hierna "EOV" genoemd).

European patents are granted by the European Patent Office established by the Convention on the Grant of European Patents (European Patent Convention) of 5 October 1973 providing for substantive patent law and a single procedure of grant.
Europese octrooien worden verleend door het Europees Octrooibureau, dat is opgericht bij het Verdrag inzake de verlening van Europese octrooien (Europees Octrooiverdrag) van 5 oktober 1973, dat zowel materieel octrooirecht als de procedure voor het verlenen van octrooien omvat.

This law shall apply to all patents granted by the European Patent Office (hereinafter referred to as "the Office") under the provisions of the European Patent Convention of 5 October 1973 (hereinafter referred to as the "Munich Convention") throughout the entire area of the Community.

The patent having unitary effect should be granted only in one of the official languages of the EPO as provided for in the Convention on the Grant of European Patents (European Patent Convention).

G. whereas on 4 December 2009 the Council adopted conclusions on the main features of the future patent system based on two pillars: (i) the creation of a unified patent litigation system, and (ii) the creation of an EU patent – a legal instrument for granting patents valid across the EU as a whole; whereas the Council considered that those conclusions should form part of the overall final agreement on a package of measures for an Enhanced Patent System in Europe comprising the creation of a European and EU Patents Court (EEUPC), an EU patent, including the separate regulation on the translation arrangements, an Enhanced Partnership between the European Patent Office and central industrial property offices of Member States and, to the extent necessary, amendments to the European Patent Convention,
G. overwegende dat de Raad op 4 december 2009 conclusies heeft aangenomen over de belangrijkste kenmerken van het toekomstige octrooisysteem, gebaseerd op twee pijlers: (i) de instelling van een eenvormig systeem voor octrooigeschillen, en (ii) de instelling van een EU-octrooi – een rechtsinstrument voor het verlenen van octrooien die in de hele EU geldig zijn; overwegende dat de Raad van oordeel was dat deze conclusies deel moesten uitmaken van het algemene eindakkoord inzake een pakket maatregelen voor een verbeterd octrooisysteem in Europa, die moesten uitmonden in een Gerecht voor het Europees en het EU-octrooi (EEUPC), een EU-octrooi, met een afzonderlijke verordening inzake de vertaalregeling, een versterkt partnerschap tussen het Europees Octrooibureau en de centrale diensten voor de industriële eigendom van de lidstaten en, voor zover nodig, wijzigingen in het Europees Octrooiverdrag,

In addition, there is the fact that such an expensive patent would ultimately discriminate against medium-sized businesses, because the few large companies which exist – and they will be not only European but also, above all, non-European companies – will register their patents throughout the Community under this new European patent, while small and medium-sized enterprises – and they account for 70% or more of all patent holders – will be unable to do so because of the costs involved and will have to rely on small, inferior, national patents and regulations under the European Patent Convention. This second-class society in patent legislation cannot be what we want in the European Union.
Daarbij komt dat een dergelijk extreem duur octrooi er ook toe zou leiden dat middelgrote ondernemingen worden gediscrimineerd. Dan zullen de weinige grote ondernemingen die er bestaan – en dat zullen niet alleen Europese, maar vooral ook niet-Europese bedrijven zijn – hun octrooien in de gehele gemeenschap onder dit nieuwe Europese octrooi aanmelden, terwijl kleine en middelgrote ondernemingen – en dat zijn 70 procent of meer van alle octrooihouders – zich dit door de hoge kosten niet zullen kunnen permitteren. Zij zullen aangewezen zijn op kleinere, inferieure nationale octrooien en op de regelingen die onder het Europees Octrooiverdrag vallen. Deze tweeklassenmaatschappij in het octrooirecht kan niet zijn wat we in de Europese Unie willen.
