An EGTC should therefore be able to implement operations with financial support other than that provided by the Union's cohesion policy. In addition, it should be clarified that a given competence needed for the efficient implementation of an EGTC should be represented by every member in each of the Member States represented unless the Member State or third country approves participation where the member is not competent for all the tasks specified in the convention.

The efficiency and effectiveness of EGTCs should be enhanced by broadening the nature of EGTCs, removing persistent barriers and facilitating the establishment and operation of EGTCs while maintaining the Member States' ability to limit the actions that EGTCs are able to carry out without Union financial support.
De efficiëntie en doelmatigheid van EGTS'en dient verbeterd te worden door de opzet van EGTS'en te verbreden, bestaande belemmeringen weg te nemen en de oprichting en operatie van EGTS'en te vergemakkelijken en tegelijkertijd de mogelijkheid te behouden dat lidstaten de acties die EGTS'en kunnen uitvoeren zonder financiële steun van de Unie, kunnen beperken.

The efficiency and effectiveness of EGTCs should be enhanced by broadening the nature of EGTCs, removing persisting barriers and facilitating the establishment and operations of EGTCs while maintaining the Member States’ possibility to limit the actions that EGTC’s may carry out without the EU financial support .It is recalled that under Regulation (EC) No 1083/2006 EGTC's have in each Member State the most extensive legal capacity, including also the possibility to conclude agreements with other EGTCs or other legal entities for the purposes of carrying out joint cooperation projects to, inter alia, provide for more efficient operation of macro-regional strategies.
De efficiëntie en doelmatigheid van EGTS'en dient verbeterd te worden door de opzet van EGTS'en te verbreden, de nog bestaande belemmeringen weg te nemen en de oprichting en werkzaamheden van EGTS'en te vergemakkelijken en tegelijkertijd de mogelijkheid voor de lidstaten te behouden om de acties die EGTS'en kunnen uitvoeren zonder financiële steun van de Unie te beperken . 1. The convention and the statutes and any subsequent amendments thereto shall be registered or published, or both, according to the applicable national law in the Member State where the EGTC concerned has its registered office. The EGTC shall acquire legal personality on the day of registration or publication, whichever occurs first.

De overeenkomst en de statuten en eventuele latere wijzigingen daarvan worden geregistreerd en/of bekendgemaakt overeenkomstig het toepasselijke nationale recht van de lidstaat waar de betreffende EGTS haar statutaire zetel heeft. De EGTS verkrijgt rechtspersoonlijkheid op de datum van de registratie of de bekendmaking, naargelang welke datum eerst komt.

“3. Following notification under paragraph 2 by a prospective member, the Member State concerned shall approve the convention, taking into account its constitutional structure, and the prospective member's participation in the EGTC, unless it considers that such participation is not in conformity with this Regulation, other Union law concerning the activities of the EGTC or national law concerning the competences of the prospective member or that such participation is not justified for reasons of public interest or of public policy of that Member State.
3. Na kennisgeving krachtens lid 2 door een kandidaat-lid stemt de betrokken lidstaat, rekening houdend met zijn constitutionele bestel, in met de overeenkomst en met de deelneming van het kandidaat-lid aan de EGTS, tenzij de lidstaat van oordeel is dat deze deelneming niet in overeenstemming is met deze verordening, met andere EU-wetgeving betreffende de activiteiten van de EGTS of met nationale wetgeving inzake de bevoegdheden van het kandidaat-lid, of dat deze deelneming niet gerechtvaardigd is om redenen van algemeen belang of overheidsbeleid van die lidstaat.

Where an EGTC carries out any activity in contravention of a Member State's provisions on public policy, public security, public health or public morality, or in contravention of the public interest of a Member State, a competent body of that Member State may prohibit that activity on its territory or require those members which have been formed under its law to withdraw from the EGTC unless the EGTC ceases the activity in question.
Indien een EGTS een activiteit uitoefent die in strijd is met bepalingen van een lidstaat inzake de openbare orde, de openbare veiligheid, de volksgezondheid of de openbare zeden, of met het algemeen belang van een lidstaat, kan een bevoegd orgaan van die lidstaat deze activiteit op zijn grondgebied verbieden, of van de onder zijn nationale wetgeving opgerichte leden eisen dat zij zich uit de EGTS terugtrekken, tenzij de EGTS de desbetreffende activiteit staakt.

1. Notwithstanding the provisions on dissolution contained in the convention, on an application by any competent authority with a legitimate interest, the competent court or authority of the Member State where an EGTC has its registered office shall order the EGTC to be wound up if it finds that the EGTC no longer complies with the requirements laid down in Articles 1(2) or 7 or, in particular, that the EGTC is acting outside the confines of the tasks laid down in Article 7.

Onverminderd de in de overeenkomst opgenomen bepalingen inzake ontbinding gelast de bevoegde rechtbank of de bevoegde autoriteit van de lidstaat waar de EGTS haar statutaire zetel heeft, op verzoek van een bevoegde autoriteit met een rechtmatig belang, de ontbinding van de EGTS wanneer zij constateert dat de EGTS niet langer voldoet aan de vereisten van artikel 1, lid 2, of artikel 7, en met name wanneer de EGTS handelt buiten de in artikel 7 neergelegde taken.

Within 10 working days of the registration or publication of the convention and the statutes in the country in which the EGTC has its registered office, the EGTC notifies the Committee of the Regions (CoR) which keeps a register of EGTCs.
Binnen tien werkdagen na de registratie of publicatie van de overeenkomst en de statuten in het land waar de EGTS haar statutaire zetel heeft, brengt de EGTS het Comité van de Regio’s (CvdR) op de hoogte.
