1. After notification to the Secretary-General, DG SAFE may conduct security inquiries, in the framework of investigations into security incidents in order to prevent similar incidents in the future.

The Commission asks ENISA to: · Assist the Member States in developing strong national cyber resilience capabilities, notably by building expertise on security and resilience of industrial control systems, transport and energy infrastructure · Examine in 2013 the feasibility of Computer Security Incident Response Team(s) for Industrial Control Systems (ICS-CSIRTs) for the EU. · Continue supporting the Member States and the EU institutions in carrying out regular pan-European cyber incident exercises which will also constitute the operational basis for the EU participation in international cyber incident exercises.

Member states shall implement the obligation to notify security incidents in a way that minimises the administrative burden in case the security incident is also a personal data breach in line with the Regulation of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data[28].

The processing of personal data to the extent strictly necessary and proportionate for the purposes of ensuring network and information security, i.e. the ability of a network or an information system to resist, at a given level of confidence, accidental events or unlawful or malicious actions that compromise the availability, authenticity, integrity and confidentiality of stored or transmitted personal data, and the security of the related services offered by, or accessible via, those networks and systems, by public authorities, by computer emergency response teams (CERTs), computer security incident response teams (CSIRTs), by providers of electronic communications networks and services and by providers of security technologies and services, constitutes a legitimate interest of the data controller concerned.

While the obligations set out in this directive do not extend to key providers of information society services, as defined in Directive 98/34/EC of the European Parliament and of the Council of 22 June 1998 laying down a procedure for the provision of information in the field of technical standards and regulations and of rules on Information Society services, which underpin downstream information society services or on-line activities, such as e-commerce platforms, Internet payment gateways, social networks, search engines, cloud computing services in general or application stores, these may, on a voluntary basis, inform the competent authority or single point of contact of those network security incidents they deem appropriate, and the competent authority or the single point of contact should, if reasonably possible, present the market operators that informed of the incident with strategically analysed information that will help overcome the security threat.

4. Feedback processes shall be defined in the Security Policy to ensure that information about the type, handling and outcome of a security incident is communicated to the System Security Officer and to the Local Security Officer for the Communication Infrastructure, once the incident has been dealt with and is no longer in progress.
4. In het beveiligingsbeleid wordt voorzien in terugkoppelingsprocessen om te waarborgen dat informatie over de aard, de afhandeling en de gevolgen van een veiligheidsincident wordt meegedeeld aan de systeembeveiligingsfunctionaris en de plaatselijke beveiligingsfunctionaris voor de communicatie-infrastructuur, zodra het incident is afgehandeld en afgesloten.

4. Ship security plan means a plan developed to ensure the application of measures on board the ship designed to protect persons on board, cargo, cargo transport units, ship's stores or the ship from the risks of a security incident.

5. Port facility security plan means a plan developed to ensure the application of measures designed to protect the port facility and ships, persons, cargo, cargo transport units and ship's stores within the port facility from the risks of a security incident.
