Port operators or the competent authority governing the port shall ensure that ports include equipment necessary to ensure the environmental performance of ships in ports, in particular electricity supply facilities as well as reception facilities for ship generated waste and cargo residues in accordance with Directive 2000/59/EC of the European Parliament and of the Council of 27 November 2000 on port reception facilities for ship-generated waste and cargo residues and with Directive 2012/./EU on the sulphur content of marine fuels, and electricity supply facilities.

Member States shall ensure that ports include equipment necessary to assist the environmental performance of ships in ports, in particular reception facilities for ship-generated waste and cargo residues in accordance with Directive 2000/59/EC of the European Parliament and of the Council (31) and in compliance with other relevant Union law.

Reiterates its call on the Member States and the Commission, in view of the air pollution affecting many port towns and regions, to provide significantly better incentives for the provision of land-based electricity for ships in port; calls, therefore, for a proposal for an amendment to Council Directive 2003/96/EC of 27 October 2003 restructuring the Community framework for the taxation of energy products and electricity, whereby those Member States which take advantage of the tax exemption on bunker oil pursuant to Article 14 of that Directive would be required to exempt land-based electricity from tax to the same extent; the equal treatment for tax purposes of electricity and bunker oil would be a major incentive for ports and ship-owners to help reduce air pollution in port towns by investing in the electricity supply for ships in port;

The main objective of Directive 2005/65/EC[1] of the European Parliament and of the Council of 26 October 2005 on enhancing port security (‘the Directive’ or ‘the Directive on port security’) is to complement the measures adopted in 2004 by means of Regulation (EC) No 725/2004[2] of the European Parliament and of the Council of 31 March 2004 on enhancing ship and port facility security (‘the Regulation’).
Richtlijn 2005/65/EG[1] van het Europees Parlement en de Raad van 26 oktober 2005 betreffende het verhogen van de veiligheid van havens (hierna “de richtlijn” of “de richtlijn havenveiligheid” genoemd) heeft als belangrijkste doel de maatregelen aan te vullen die in 2004 zijn genomen bij Verordening (EG) nr. 725/2004[2] van het Europees Parlement en de Raad van 31 maart 2004 betreffende de verbetering van de beveiliging van schepen en havenfaciliteiten (hierna “de verordening” genoemd).

1.3 Such control measures are as follows: inspection of the ship, delaying the ship, detention of the ship, restriction of operations including movement within the port, or expulsion of the ship from port.

8. Notwithstanding the provisions of paragraphs 2 and 3, Member States shall ensure, when ship security plans and port facility security plans are approved, that such plans contain appropriate provisions to ensure that the security of ships to which this Regulation applies is not compromised by any ship or port interface or ship-to-ship activity with any ships not subject to this Regulation.

1. Certificate verification, as defined in paragraph 1.1 of Regulation 9 (Control of ships in port) of the special measures to enhance maritime security of the SOLAS Convention, shall be carried out in the port either by the competent authority for port security defined in Article 2(7) of this Regulation or by the inspectors defined in Article 2(5) of Council Directive 95/21/EC of 19 June 1995 on port State control of shipping, as last amended by Directive 2001/106/EC of the European Parliament and of the Council of 19 December 2001.

The Commission should therefore have more detailed information, particularly on the movements of ships in ports, in order to be able to carry out a detailed examination of the conditions under which the Directive is being applied.
