Without prejudice to Directive 1999/5/EC of the European Parliament and of the Council of 9 March 1999 on radio equipment and telecommunications terminal equipment and the mutual recognition of their conformity , and in particular the disability requirements laid down in Article 3(3)(f) thereof, certain aspects of terminal equipment, including consumer premises equipment intended for disabled end-users, whether their special needs are due to disability or related to ageing, should be brought within the scope of Directive 2002/22/EC (Universal Service Directive) in order to facilitate access to networks and the use of services.

The special or exclusive rights relating to terminal equipment enjoyed by national telecommunications monopolies are exercised in such a way as, in practice, to disadvantage equipment from other Member States, notably by preventing users from freely choosing the equipment that best suits their needs in terms of price and quality, regardless of its origin. The exercise of these rights is therefore not compatible with Article 37 in all the Member States except Spain and Portugal, where the national monopolies are to be adjusted progressively before the end of the transitional period provided for by the Act of Accession.
5. Overwegende dat de uitoefening van de bijzondere of uitsluitende rechten op eindapparatuur in het raam van de nationale monopolies op het gebied van telecommunicatie dusdanig geschiedt dat apparatuur uit de andere Lid-Staten in de praktijk in een nadelige positie verkeert, met name omdat de gebruikers worden belet de door hen benodigde apparatuur aan de hand van prijs en kwaliteit, ongeacht de herkomst ervan, vrijelijk te kiezen; dat de uitoefening van die rechten bijgevolg in alle Lid-Staten, met uitzondering van Spanje en Portugal waar de nationale monopolies geleidelijk moeten worden aangepast vóór het einde van de overgangsperiode volgens de Akte van Toetreding, onverenigbaar is met artikel 37;
