The Commission asked a number of Member States to remedy the shortcomings noted in inspections at the time of customs clearance as well as during post-clearance inspections and asked them to take the measures needed to improve the efficiency of customs inspections.

If the entry price of the consignment in question is not declared at the time of customs clearance, the Common Customs Tariff duty rate to be applied shall depend on the flat-rate import value or be arrived at by application of the relevant customs legislation provisions under conditions to be determined in accordance with the procedure referred to in Article 46(2) of Regulation (EC) No 2200/96.
3. Indien de invoerprijs voor de betrokken partij niet wordt opgegeven op het moment van de inklaring, hangt de toepassing van de rechten van het gemeenschappelijk douanetarief af van de forfaitaire waarde bij invoer of van de toepassing, onder overeenkomstig de procedure van artikel 46, lid 2, van Verordening (EG) nr. 2200/96 vast te stellen voorwaarden, van de desbetreffende bepalingen van de douanewetgeving.

However, the third report, on the customs clearance of fresh bananas, which resulted from an investigation conducted in five Member States, led to the conclusion that none of the systems of customs clearance in the Member States inspected were able to guarantee the correct application of Community rules in this field and proper collection of traditional own resources.
Het derde verslag daarentegen, over de inklaring van verse bananen, had betrekking op het onderzoek in vijf lidstaten en leidde tot de conclusie dat de inklaringssystemen in geen van deze lidstaten een goede toepassing van de communautaire voorschriften en een correcte inning van de traditionele eigen middelen konden garanderen.

As regards the customs clearance procedure, France has informed the Commission that since 4 February 1987 SFMI-Chronopost has carried out the customs clearance procedure in its own customs centre and has been subject to the normal customs arrangements applicable to private companies (see above).
