1. The Commission may, by means of implementing acts adopted in accordance with the examination procedure referred to in Article 323(1a), fix a corrective amount applicable to export refunds fixed in respect of the cereals and rice sectors.

(48) In order to ensure uniform conditions for the implementation of this Regulation as regards exports, implementing powers should also be conferred on the Commission in respect of measures defining the procedures for declaring and the evidence needed to prove the composition of the exported non-Annex I goods necessary for the implementation of the export refund system, the simplified evidence needed to prove arrival at destination in the case of differentiated refunds, measures on the application of horizontal provisions on export refunds for non-Annex I goods, measures on the implementation of the export refund certificate system as regards the submission, the format and the content of the application for the refund certificate, the format, the content and the period of validity of the refund certificate, the procedure for lodging applications and issuing refund certificates and for their use, the procedure for lodging a security and its amount, the level of tolerance for the amounts of export refund which were not applied for and the means of proving that the obligations derived from the refund certificate have been fulfilled.
(48) Om eenvormige voorwaarden te waarborgen voor de uitvoering van deze verordening met betrekking tot de uitvoer, moeten aan de Commissie uitvoeringsbevoegdheden worden toegekend betreffende maatregelen tot vastlegging van de procedures voor de aangifte en het bewijsmateriaal nodig om de samenstelling aan te tonen van de uitgevoerde niet in bijlage I genoemde goederen met het oog op de uitvoering van het systeem van uitvoerrestituties; het vereenvoudigde bewijsmateriaal nodig om de aankomst op de plaats van bestemming aan te tonen in het geval van gedifferentieerde restituties, maatregelen betreffende de toepassing van horizontale bepalingen inzake uitvoerrestituties voor niet in bijlage I genoemde goederen; maatregelen inzake de uitvoering van het systeem van restitutiecertificaten met betrekking tot het indienen, het formaat en de inhoud van aanvragen van restitutiecertificaten, het formaat, de inhoud en de geldigheidsduur van restitutiecertificaten, de procedure voor het indienen van aanvragen voor en de afgifte van restitutiecertificaten, en voor het gebruik ervan, de procedures voor het stellen van een zekerheid en het bedrag ervan, de tolerantiemarge betreffende de bedragen van niet aangevraagde uitvoerrestituties en de wijze waarop moet worden aangetoond dat aan de uit het restitutiecertificaat voortvloeiende verplichtingen is voldaan.

Where necessary, the Commission may, by means of implementing acts adopted without the application of Article 323, amend the corrective amounts.
Zo nodig kan de Commissie deze correctiebedragen ook wijzigen, middels uitvoeringshandelingen zonder toepassing van artikel 323.

(49) In order to ensure uniform conditions for the implementation of this Regulation as regards exports and certain general provisions, implementing powers should also be conferred on the Commission in respect of measures on the treatment of refund certificates by the Member States and the exchange of information and the specific administrative assistance between the Member States as regards the refund certificates, measures on the fixing of the global amount allocated to small exporters and the individual threshold of exemption from the presentation of refund certificates, measures on the issuing of replacement refund certificates and duplicate refund certificates, measures limiting the amounts for which refund certificates may be issued, rejecting amounts applied for in respect of those certificates and suspending the lodging of applications for refund certificates where amounts that exceed available amounts fixed on the basis of the commitments resulting from international agreements, are applied for, necessary procedural rules and technical criteria for the application of other measures with regard of exports, measures on fixing the applicable duty in case of direct offsetting in preferential trade and the related amounts payable on exports to the country or region concerned, measures ensuring that processed agricultural products declared for export under a preferential trade agreement are not in fact exported under a non- preferential agreement or vice versa , measures concerning the methods of qualitative and quantitative analysis of processed agricultural products and non-Annex I goods, the technical provisions necessary for their identification and the procedures for the purpose of their classification in the Combined Nomenclature.
(49) Om eenvormige voorwaarden te waarborgen voor de uitvoering van deze verordening met betrekking tot de uitvoer en bepaalde algemene bepalingen, moeten aan de Commissie uitvoeringsbevoegdheden worden toegekend betreffende maatregelen inzake de afhandeling van restitutiecertificaten door de lidstaten en de uitwisseling van informatie en de specifieke administratieve bijstand tussen de lidstaten ten aanzien van de restitutiecertificaten; maatregelen inzake de vaststelling van het totale voor kleine exporteurs toegewezen bedrag en de individuele drempel waaronder geen restitutiecertificaten hoeven te worden overgelegd; maatregelen inzake de afgifte van vervangende restitutiecertificaten en van duplicaten van restitutiecertificaten , maatregelen tot beperking van de bedragen waarvoor restitutiecertificaten kunnen worden afgegeven, tot afwijzing van in het kader van die certificaten aangevraagde bedragen en tot schorsing van de indiening van aanvragen voor restitutiecertificaten wanneer bedragen worden aangevraagd die uitstijgen boven de beschikbare bedragen als vastgesteld op basis van de verplichtingen die uit internationale overeenkomsten voortvloeien ; noodzakelijke procedurele voorschriften, en technische criteria voor de toepassing van andere maatregelen in verband met de uitvoer; maatregelen inzake de vaststelling van het toepasselijke recht bij rechtstreekse compensatie in het preferentiële handelsverkeer en de daaraan gerelateerde bedragen die moeten worden betaald bij uitvoer naar het land of de regio in kwestie ; maatregelen die waarborgen dat verwerkte landbouwproducten die in het kader van een preferentiële handelsovereenkomst ten uitvoer worden aangegeven, niet toch in het kader van een niet-preferentiële overeenkomst worden uitgevoerd, of omgekeerd ; maatregelen inzake de methoden voor kwalitatieve en kwantitatieve analyses van verwerkte landbouwproducten en niet in bijlage I genoemde goederen, inzake de technische voorschriften voor de identifica ...

2. Where amounts are applied for that exceed available amounts fixed on the basis of the commitments resulting from the international agreements concluded in accordance with the TFEU , the Commission may adopt implementing acts, without applying the procedure referred to in Article 44(2) or (3) , limiting the amounts for which refund certificates may be issued, rejecting amounts applied for in respect of refund certificates and suspending the lodging of applications for refund certificates.
2. Wanneer hoeveelheden worden aangevraagd die uitstijgen boven de hoeveelheden die zijn vastgesteld op basis van verplichtingen die voortvloeien uit overeenkomstig het VWEU gesloten internationale overeenkomsten , kan de Commissie uitvoeringshandelingen vaststellen zonder toepassing van de in artikel 44, lid 2 en lid 3, bedoelde procedure waarin de hoeveelheden waarvoor restitutiecertificaten kunnen worden afgegeven, worden beperkt, de in het kader van restitutiecertificaten aangevraagde hoeveelheden worden afgewezen en het indienen van aanvragen voor restitutiecertificaten wordt geschorst.
