10. By 3 July 2019, the Commission shall, after consulting ESMA, submit a report to the European Parliament and to the Council on the impact of Article 35 and 36 of this Regulation on newly established and authorised CCPs as referred to in Article 35(5) and trading venues connected to those CCPs by close links and whether the transitional arrangement provided for in Article 35(5) shall be extended, weighing the possible benefits to consumers of improving competition and the degree of choice available to market participants against the possible disproportionate effect of those provisions on newly established and authorised CCPs and the constraints of local market participants in accessing global CCPs and the smooth functioning of the market.
10. Uiterlijk op 3 juli 2019 brengt de Commissie, na raadpleging van de ESMA, verslag uit aan het Europees Parlement en de Raad over het effect van de artikelen 35 en 36 van deze verordening op pas opgerichte en vergunninghoudende CTP’s als bedoeld in artikel 35, lid 5, en op handelsplatforms die nauwe banden met die CTP’s hebben, en over de vraag of de in artikel 35, lid 5, genoemde overgangsregeling moet worden uitgebreid, waarbij de mogelijke voordelen van een beter concurrentievermogen voor de consument en de mate waarin marktdeelnemers een keuze hebben, worden afgewogen tegen het mogelijke onevenredige effect van die bepalingen op pas opgerichte en vergunninghoudende CTP’s en de beperkingen van deelnemers op lokale markten om toegang te krijgen tot mondiale CTP’s en het soepel functioneren van de markt.

3. Regrets the fact that the programmes in question were designed without sufficient means to assess their consequences using impact studies or through coordination with the Employment Committee, the Social Protection Committee, the Employment, Social Policy, Health and Consumer Affairs Council (EPSCO) or the Commissioner for Employment and Social Affairs; regrets, too, the fact that the ILO was not consulted and that, despite the important social implications, the consultative bodies established by Treaty, in particular the European Economic and Social Committee (EESC) and the Committee of the Regions (CoR), were not consulted;

Pursuant to Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data , consumers should be informed by creditors of the consultation of the credit database prior to its consultation, and should have the right to access the information held on them in such a credit database in order to, where necessary, rectify, erase or block the personal data concerning them processed therein where it is inaccurate or has been unlawfully processed.
Overeenkomstig Richtlijn 95/46/EG van het Europees Parlement en de Raad van 24 oktober 1995 betreffende de bescherming van natuurlijke personen in verband met de verwerking van persoonsgegevens en betreffende het vrije verkeer van die gegevens moeten kredietgevers, wanneer zij een kredietgegevensbank raadplegen, consumenten daarvan vooraf op de hoogte brengen en consumenten moeten het recht hebben om toegang te krijgen tot de informatie die over hen in een dergelijke gegevensbank voorkomt, zodat zij, indien nodig, de hen betreffende, daarin verwerkte gegevens kunnen rectificeren, uitwissen of afschermen indien deze onnauwkeurig zijn of onrechtmatig zijn verwerkt.

4. The Commission shall be empowered to adopt delegated acts, after consulting the European Data Protection Supervisor, in accordance with Article 16 to adapt the information listed in the Annex, taking into account the criteria by which the ADR entities notified to the Commission in accordance with Article 17(2) of Directive .././EU [Office of Publications please insert number of Directive of the European Parliament and of the Council on alternative dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC (Directive on consumer ADR)] that deal with disputes covered by this Regulation define their respective scopes of application.
4. De Commissie wordt de bevoegdheid verleend om bij wege van vaststelling van gedelegeerde handelingen, na raadpleging van de Europese Toezichthouder voor gegevensbescherming, overeenkomstig artikel 16 de in de bijlage opgenomen informatie aan te passen, met inachtneming van de criteria aan de hand waarvan de overeenkomstig artikel 17, lid 2, van Richtlijn .././EU [Publicatiebureau: voeg nummer in van Richtlijn van het Europees Parlement en de Raad betreffende alternatieve beslechting van consumentengeschillen en tot wijziging van Verordening (EG) nr. 2006/2004 en Richtlijn 2009/22/EG (Richtlijn ADR consumenten)] bij de Commissie aangemelde ADR-entiteiten voor de behandeling van geschillen waarop deze verordening van toepassing is, de respectieve gebieden waarop zij bevoegd zijn afbakenen.

In exercising its implementing powers, the Commission should respect the following principles: the need to ensure confidence in financial markets among investors by promoting high standards of transparency in those markets; the need to provide investors with a wide range of competing investments and a level of disclosure and protection tailored to their circumstances; the need to ensure that independent regulatory authorities enforce the rules consistently, especially as regards the fight against economic crime; the need for high levels of transparency and consultation with all market participants and with the European Parliament and the Council; the need to encourage innovation in financial markets if they are to be dynamic and efficient; the need to ensure market integrity by close and reactive monitoring of financial innovation; the importance of reducing the cost of, and increasing access to, capital; the balance of costs and benefits to market participants on a long-term basis (including small and medium-sized businesses and small investors) in any implementing measures; the need to foster the international competitiveness of EU financial markets without prejudice to a much-needed extension of international cooperation; the need to achieve a level playing field for all market participants by establishing EU-wide regulations every time it is appropriate; the need to respect differences in national markets where these do not unduly impinge on the cohesion of the single market; and the need to ensure coherence with other Community legislation in this area, as imbalances in information and a lack of transparency may jeopardise the operation of the markets and above all harm consumers and small investors.
Bij de uitoefening van haar uitvoeringsbevoegdheden dient de Commissie de volgende beginselen in acht te nemen: het vertrouwen van beleggers in de financiële markten moet worden opgebouwd door hoge normen met betrekking tot de transparantie op de financiële markten te bevorderen; aan beleggers moet een breed scala van alternatieve beleggingsmogelijkheden worden geboden, alsmede een niveau van informatievoorziening en bescherming dat op hun situatie is toegesneden; er moet voor worden gezorgd dat onafhankelijke regelgevende autoriteiten de voorschriften consequent handhaven, met name bij de bestrijding van economische criminaliteit; een hoge mate van transparantie en uitgebreid overleg met alle marktdeelnemers en met het Europees Parlement en de Raad zijn nodig; innovatie op de financiële markten moet worden gestimuleerd om deze dynamisch en doelmatig te maken; er moet worden gezorgd voor integriteit van de markten door nauwgezet en reactief toezicht uit te oefenen op financiële innovatie; verlaging van de kosten van en verbetering van de toegang tot kapitaal zijn van belang; bij uitvoeringsmaatregelen moet een afweging plaatsvinden van de kosten en baten op de lange termijn voor de marktdeelnemers (met inbegrip van kleine en middelgrote ondernemingen en kleine beleggers); het internationale concurrentievermogen van de financiële markten in de Europese Unie moet worden versterkt zonder dat afbreuk wordt gedaan aan de hoognodige uitbreiding van de internationale samenwerking; er moeten voor alle marktdeelnemers gelijke concurrentievoorwaarden worden gecreëerd door telkens wanneer dit dienstig is op EU-niveau regelgeving vast te stellen; er moet rekening worden gehouden met verschillen tussen de nationale markten, voorzover deze de samenhang van de interne markt niet bovenmatig aantasten; de samenhang met andere communautaire wetgeving op dit gebied moet worden gewaarborgd, omdat een onevenwichtige informatievoorziening en een gebrek aan transparantie de wer ...

Records its disappointment with the Council's decision to restructure the Council dealing with consumer affairs by integrating it with Employment, Social Affairs and Public Health policy; regrets the absence of any consultation over this, and notes with disquiet the effect of this on the integration of consumer concerns in the development of the Internal Market where they will inevitably be subordinate;

The proper involvement of consumer organisations in EU policies concerns all EU institutions. Consultation of European and national consumer organisations already takes place with the Parliament and the Council.
Alle EU-instellingen moeten de consumentenorganisaties op de juiste wijze betrekken bij de beleidsterreinen van de EU. Het Europees Parlement en de Raad voeren reeds overleg met de nationale en Europese consumentenorganisaties.
