Economic crimes, unauthorised access and sabotage: Many countries have passed laws that address computer-specific economic crime and define new offences related to unauthorised access to computer systems (e.g., hacking, computer sabotage and distribution of viruses, computer espionage, computer forgery, and computer fraud [25]) and new forms of committing offences (e.g., computer manipulations instead of deceiving a human).

Four categories of criminal offences are listed in the current draft C.o.E. Cybercrime Convention: 1) Offences against the confidentiality, integrity and availability of computer data and systems; 2) Computer-related offences; 3) Content-related offences; 4) Offences related to infringements of copyright and related rights.

The case may be considered minor, for example, when the damage caused by the offence and/or the risk it carries to public or private interests, such as to the integrity of a computer system or computer data, or to a person's integrity, rights and other interests, is insignificant or is of such nature, that the imposition of a criminal penalty within the legal threshold or the imposition of criminal liability is not necessary.

Stresses that organised crime uses communication and information technologies for illegal purposes, to commit offences involving identity theft, cybercrime, fraud, illegal gambling and rigged sports events; calls, in this connection, for the development of a coherent European legislative framework; calls on EU institutions to call on as many as possible of their international partners to sign and ratify the 2001 Convention on Computer Crime; emphasises the trend that criminal organisations increasingly focus on opportunities for money laundering or financial crime which could result in an increasingly widespread development of internet-based criminal activities;

The first areas in which this is envisaged might, in accordance with the Action Plan, be offences linked to organised crime, terrorism and drug trafficking such as trafficking in human beings and the sexual exploitation of children, offences against the drug-trafficking legislation, corruption, computer fraud, offences committed by terrorists, offences against the environment, offences via the Internet and money-laundering linked to these forms of crime.
